H.F. 2298 Section 1. SILICA SAND MINING —— MORATORIUM. 1 1. For purposes of this section, “silica sand” means 2 well-rounded, sand-sized grains of quartz, also known as 3 silicon dioxide, with few impurities in terms of other minerals 4 that is typically used in the process of hydraulic fracturing 5 of shale. “Silica sand” does not include common rock, stone, 6 aggregate, gravel, sand with a low quartz level, or silica 7 compounds recovered as a by-product of metallic mining. 8 2. On or after the effective date of this Act, the 9 department of agriculture and land stewardship shall not issue 10 a new mining license pursuant to section 208.7 for an operator 11 to engage in the mining of silica sand and shall not approve 12 the registration of a new mine site for silica sand pursuant 13 to section 208.9. 14 Sec. 2. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 15 immediate importance, takes effect upon enactment. 16 EXPLANATION 17 The inclusion of this explanation does not constitute agreement with 18 the explanation’s substance by the members of the general assembly. 19 This bill relates to the mining of silica sand. 20 The bill prohibits the department of agriculture and land 21 stewardship, on or after the effective date of the bill, from 22 issuing a new mining license for an operator to engage in the 23 mining of silica sand and from approving the registration of a 24 new mine site for silica sand. 25 The bill takes effect upon enactment. 26 -1- LSB 6037YH (2) 85 tm/nh 1/ 1
