  1 A Joint Resolution proposing an amendment to the Constitution

  1  1    Section 1.  The following amendment to the Constitution of
  1  2 the State of Iowa is proposed:
  1  3    Article VII of the Constitution of the State of Iowa is
  1  4 amended by adding the following new section:
  1  5 Sales tax.SEC. 11.  The fund created by the general
  1  6 assembly for the construction, maintenance, and supervision of
  1  7 the public highways exclusively within the state as provided in
  1  8 section 8 of this article shall be annually credited with the
  1  9 amount generated by a sales tax rate of one=half of one percent
  1 10 as may be imposed by the state upon the retail sales price of
  1 11 tangible personal property and the furnishing of enumerated
  1 12 services sold in this state that remain after any transfers
  1 13 of sales tax revenues required by law of this state in effect
  1 14 on the date of ratification of this amendment to local school
  1 15 districts to be used solely for school infrastructure purposes
  1 16 or school district property tax relief and that remain after
  1 17 any transfers of sales tax revenues required by law of this
  1 18 state in effect on the date of ratification of this amendment
  1 19 to the natural resources and outdoor recreation trust fund
  1 20 created under section 10 of this article.
  1 21    Sec. 2.  REFERRAL AND PUBLICATION.  The foregoing proposed
  1 22 amendment to the Constitution of the State of Iowa is referred
  1 23 to the general assembly to be chosen at the next general
  1 24 election for members of the general assembly, and the secretary
  1 25 of state is directed to cause the proposed amendment to be
  1 26 published for three consecutive months previous to the date of
  1 27 that election as provided by law.
  1 28                           EXPLANATION
  1 29 The inclusion of this explanation does not constitute agreement with
  1 30 the explanation's substance by the members of the general assembly.
  1 31    This joint resolution proposes an amendment to the
  1 32 Constitution of the State of Iowa relating to funding for
  1 33 the construction, maintenance, and supervision of the public
  1 34 highways.
  1 35    The joint resolution provides that the amount generated by
  2  1 a sales tax rate of one=half of 1 percent as may be imposed by
  2  2 the state shall be deposited in the fund created by the general
  2  3 assembly for the construction, maintenance, and supervision
  2  4 of the public highways, as provided in article VII, section 8
  2  5 of the Constitution of the State of Iowa, after any transfers
  2  6 of state sales tax revenues required by law in effect on
  2  7 the date of ratification of the amendment to local school
  2  8 districts to be used solely for school infrastructure purposes
  2  9 or school district property tax relief and after any transfers
  2 10 of sales tax revenues required by law in effect on the date
  2 11 of ratification of this amendment to the natural resources
  2 12 and outdoor recreation trust fund created under Article VII,
  2 13 section 10 of the Constitution of the State of Iowa.
  2 14    The joint resolution, if adopted, would be published and
  2 15 then referred to the next general assembly (87th) for adoption
  2 16 a second time, before being submitted to the electorate for
  2 17 ratification.
