Senate File 2193 AN ACT RELATING TO THE ADMISSION OR RETENTION OF PARTICIPANTS IN AN ADULT DAY SERVICES PROGRAM. BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: Section 1. NEW SECTION . 231D.19 Admission and retention of participants. An adult day services program shall not knowingly admit or retain a participant who meets any of the following criteria: 1. Is under the age of eighteen. 2. Requires routine three-person assistance with standing, transfer, or evacuation. 3. Poses a danger to the participant, other participants, or the adult day services program staff. “Pose a danger” may include but is not limited to the following situations: a. The participant chronically elopes despite intervention. b. The participant is sexually or physically aggressive or abusive. c. The participant’s verbal abuse is unmanageable by staff.
