REBUILD IOWA INFRASTRUCTURE FUND ==== 1 4 APPROPRIATIONS. There is appropriated from the rebuild Iowa 1 5 infrastructure fund to the following departments and agencies 1 6 for the following fiscal years, the following amounts, or so 1 7 much thereof as is necessary, to be used for the purposes 1 8 designated: 1 9 1. DEPARTMENT OF ADMINISTRATIVE SERVICES 1 10 a. For major maintenance projects included on the 1 11 department of administrative services unfunded major 1 12 maintenance project requests list issued for the third quarter 1 13 of the fiscal year beginning July 1, 2015, and ending June 30, 1 14 2016: 1 15 FY 2016=2017: 1 16 .................................................. $ 11,250,000 1 17 However, of the moneys appropriated in this subsection, 1 18 $100,000 is allocated for the costs of major maintenance of 1 19 monuments without dedicated funds available for maintenance and 1 20 restoration, subject to a requirement that moneys shall not be 1 21 allocated unless a match of at least $2 for each $1 allocated 1 22 is received from private sources. 1 23 In addition, of the moneys appropriated in this subsection, 1 24 $250,000 is allocated for the costs of installing outdoor 1 25 lighting at the Iowa state capitol. 1 26 b. For costs associated with improvements to and renovation 1 27 of the Wallace building for extending the useful life of the 1 28 building: 1 29 FY 2016=2017: 1 30 .................................................. $ 1 1 31 2. DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP 1 32 a. (1) For deposit in the water quality initiative 1 33 fund created in section 466B.45 for purposes of supporting 1 34 the water quality initiative administered by the soil 1 35 conservation division as provided in section 466B.42, including 2 1 salaries, support, maintenance, and miscellaneous purposes, 2 2 notwithstanding section 8.57, subsection 5, paragraph "c": 2 3 FY 2016=2017: 2 4 .................................................. $ 5,100,000 2 5 (2) (a) The moneys appropriated in this lettered 2 6 paragraph shall be used to support demonstration projects in 2 7 subwatersheds as designated by the department that are part 2 8 of high=priority watersheds identified by the water resources 2 9 coordinating council established pursuant to section 466B.3. 2 10 (b) The moneys appropriated in this lettered paragraph 2 11 shall be used to support demonstration projects in watersheds 2 12 generally, including regional watersheds, as designated by the 2 13 division and high=priority watersheds identified by the water 2 14 resources coordinating council established pursuant to section 2 15 466B.3. 2 16 (c) Of the moneys appropriated in this lettered paragraph, 2 17 $450,000 is allocated to the Iowa nutrient research center at 2 18 Iowa state university of science and technology for nutrient 2 19 water monitoring network technology and equipment. Of the 2 20 moneys allocated in this subparagraph division, not more than 2 21 $150,000 may be used for the operations and maintenance of the 2 22 nutrient water monitoring network. 2 23 (3) In supporting projects in watersheds and subwatersheds 2 24 as provided in subparagraph (2), subparagraph divisions (a) and 2 25 (b), all of the following shall apply: 2 26 (a) The demonstration projects shall utilize water quality 2 27 practices as described in the latest revision of the document 2 28 entitled "Iowa Nutrient Reduction Strategy" initially presented 2 29 in November 2012 by the department of agriculture and land 2 30 stewardship, the department of natural resources, and Iowa 2 31 state university of science and technology. 2 32 (b) The division shall implement demonstration projects 2 33 as provided in subparagraph division (a) by providing 2 34 for participation by persons who hold a legal interest in 2 35 agricultural land used in farming. To every extent practical, 3 1 the division shall provide for collaborative participation by 3 2 such persons who hold a legal interest in agricultural land 3 3 located within the same subwatershed. 3 4 (c) The division shall implement demonstration projects on 3 5 a cost=share basis as determined by the division. However, the 3 6 state's share of the amount shall not exceed 50 percent of the 3 7 estimated cost of establishing the practice as determined by 3 8 the division or 50 percent of the actual cost of establishing 3 9 the practice, whichever is less. 3 10 (d) The demonstration projects shall be used to educate 3 11 other persons about the feasibility and value of establishing 3 12 similar water quality practices. The division shall promote 3 13 field day events for purposes of allowing interested persons to 3 14 establish water quality practices on their agricultural land. 3 15 (e) The division shall conduct water quality evaluations 3 16 within supported subwatersheds. Within a reasonable period 3 17 after accumulating information from such evaluations, the 3 18 division shall create an aggregated database of water quality 3 19 practices. Any information identifying a person holding a 3 20 legal interest in agricultural land or specific agricultural 3 21 land shall be a confidential record. 3 22 (4) The moneys appropriated in this lettered paragraph 3 23 shall be used to support education and outreach in a manner 3 24 that encourages persons who hold a legal interest in 3 25 agricultural land used for farming to implement water quality 3 26 practices, including the establishment of such practices in 3 27 watersheds generally, and not limited to subwatersheds or 3 28 high=priority watersheds. 3 29 (5) The moneys appropriated in this lettered paragraph 3 30 may be used to contract with persons to coordinate the 3 31 implementation of efforts provided in this paragraph. 3 32 (6) The moneys appropriated in this lettered paragraph 3 33 may be used by the department to support urban soil and water 3 34 conservation efforts, which may include but are not limited 3 35 to management practices related to bioretention, landscaping, 4 1 the use of permeable or pervious pavement, and soil quality 4 2 restoration. The moneys shall be allocated on a cost=share 4 3 basis as provided in chapter 161A. 4 4 (7) Notwithstanding any other provision of law to the 4 5 contrary, the department may use moneys appropriated in 4 6 this lettered paragraph to carry out the provisions of this 4 7 paragraph on a cost=share basis in combination with other 4 8 moneys available to the department from a state or federal 4 9 source. 4 10 (8) Not more than 10 percent of the moneys appropriated in 4 11 this lettered paragraph may be used for costs of administration 4 12 and implementation of the water quality initiative administered 4 13 by the soil conservation division. 4 14 b. For deposit in the agricultural drainage well water 4 15 quality assistance fund created in section 460.303 for 4 16 purposes of supporting the agricultural drainage well water 4 17 quality assistance program as provided in section 460.304, 4 18 notwithstanding section 8.57, subsection 5, paragraph "c": 4 19 FY 2016=2017: 4 20 .................................................. $ 1,920,000 4 21 Not more than 10 percent of the moneys appropriated in this 4 22 lettered paragraph may be used for costs of administration and 4 23 implementation of soil conservation practices. 4 24 3. SECRETARY OF STATE 12 25 For the updating and upgrading capabilities of aging voter 12 26 registration systems and business services data systems to 12 27 meet current and future expectations of open and transparent 12 28 elections: 12 29 FY 2016=2017: 12 30 .................................................. $ 550,000 12 31 Moneys appropriated in this subsection shall be expended by 12 32 the secretary of state in consultation with the office of the 12 33 chief information officer. 12 34 Sec. 4. REVERSION. For purposes of section 8.33, unless 12 35 specifically provided otherwise, unencumbered or unobligated 13 1 moneys made from an appropriation in this division of this Act 13 2 shall not revert but shall remain available for expenditure for 13 3 the purposes designated until the close of the fiscal year that 13 4 ends three years after the end of the fiscal year for which the 13 5 appropriation is made. However, if the project or projects for 13 6 which such appropriation was made are completed in an earlier 13 7 fiscal year, unencumbered or unobligated moneys shall revert at 13 8 the close of that same fiscal year. 13 9 DIVISION III 13 10 MISCELLANEOUS APPROPRIATIONS 13 11 Sec. 5. TECHNOLOGY REINVESTMENT FUND. There is 13 12 appropriated from the technology reinvestment fund created in 13 13 section 8.57C to the department of education for the fiscal 13 14 year beginning July 1, 2016, and ending June 30, 2017, the 13 15 following amount, or so much thereof as is necessary, to be 13 16 used for the purpose designated: 13 17 For the continued development and implementation of an 13 18 educational data warehouse that will be utilized by teachers, 13 19 parents, school district administrators, area education agency 13 20 staff, department of education staff, and policymakers: 13 21 .................................................. $ 236,161 13 22 The department may use a portion of the moneys appropriated 13 23 in this section for an e=transcript data system capable 13 24 of tracking students throughout their education via 13 25 interconnectivity with multiple schools. 13 26 Sec. 6. STATE BOND REPAYMENT FUND. There is appropriated 13 27 from the state bond repayment fund created in section 8.57F 13 28 to the following departments and agencies for the fiscal year 13 29 beginning July 1, 2016, and ending June 30, 2017, the following 13 30 amounts, or so much thereof as is necessary, to be used for the 13 31 purposes designated, notwithstanding section 8.57F, subsection 13 32 1, paragraph "b": 13 33 1. For purposes of section 8.33, unless 14 21 specifically provided otherwise, unencumbered or unobligated 14 22 moneys made from an appropriation in this division of this Act 14 23 shall not revert but shall remain available for expenditure for 14 24 the purposes designated until the close of the fiscal year that 14 25 ends three years after the end of the fiscal year for which the 14 26 appropriation is made. However, if the project or projects for 14 27 which such appropriation was made are completed in an earlier 14 28 fiscal year, unencumbered or unobligated moneys shall revert at 14 29 the close of that same fiscal year. 14 30 DIVISION IV 14 31 CHANGES TO PRIOR APPROPRIATIONS 14 32 Sec. 8. 2012 Iowa Acts, chapter 1140, section 4, is amended 14 33 to read as follows: 14 34 SEC. 4. REVERSION. 14 35 1.ForExcept as provided in subsection 2, for purposes 15 1 of section 8.33, unless specifically provided otherwise, 15 2 unencumbered or unobligated moneys made from an appropriation 15 3 in this division of this Act shall not revert but shall remain 15 4 available for expenditure for the purposes designated until the 15 5 close of the fiscal year that ends three years after the end of 15 6 the fiscal year for which the appropriation was made. However, 15 7 if the project or projects for which such appropriation was 15 8 made are completed in an earlier fiscal year, unencumbered 15 9 or unobligated moneys shall revert at the close of that same 15 10 fiscal year. 15 11 2. For a grant to a nonprofit organization that provides 16 10 youth emergency and shelter services for children and their 16 11 families located in a county with a population of more than 16 12 400,000 as determined by the 2010 federal decennial census, 16 13 for infrastructure costs for expansion of an emergency youth 16 14 shelter facility, to include reimbursement of infrastructure 16 15 costs incurred by the grant recipient for the expansion of the 16 16 facility in the prior fiscal year: 16 17 FY 2015=2016: 16 18 .................................................. $ 500,000 16 19 The grant recipient that receives funding pursuant to this 16 20 lettered paragraph shall provide at least a dollar=for=dollar 16 21 matchof moneys receivedfrom both private and public sources 16 22 excluding funding from the state. The grant recipient can 16 23 meet the match requirement in this lettered paragraph through 16 24 expenditures and in=kind contributions made in any fiscal 16 25 year, and moneys received in any fiscal year, relating to the 16 26 expansion of the emergency youth shelter facility. 16 27 Sec. 12. 2015 Iowa Acts, chapter 139, section 1, subsection 16 28 13, paragraphs d and e, are amended to read as follows: 16 29d. The following 17 2 provision of this division of this Act applies retroactively to 17 3 July 1, 2015: 17 4 1. The section of this division of this Act amending 2015 17 5 Iowa Acts, chapter 139, section 1, subsection 6, paragraph d. 17 6 Sec. 14. EFFECTIVE UPON ENACTMENT. This division of this 17 7 Act, being deemed of immediate importance, takes effect upon 17 8 enactment. 17 9 DIVISION V 17 10 SHALLOW LAKES 17 11 Sec. 15. Section 456A.33B, Code 2016, is amended by adding 17 12 the following new subsection: 17 13 NEW SUBSECTION. 01. For purposes of this section, unless 17 14 the context otherwise requires: 17 15 a. "Lake" includes a significant public lake and a public 17 16 shallow lake or wetland. 17 17 b. "Public shallow lake or wetland" means a water body that 17 18 meets the following criteria: 17 19 (1) Is owned by the federal government, the state of 17 20 Iowa, a county, or a municipal government, and is maintained 17 21 principally for public use. 17 22 (2) Is a multi=use system capable of supporting diverse 17 23 wildlife, fish, or recreational opportunities. 17 24 (3) Has a surface water area of at least ten acres. 17 25 (4) Does not have a watershed=to=lake surface area ratio of 17 26 greater than two hundred to one. 17 27 (5) Is an open freshwater system where maximum depth is 17 28 typically less than six to eight feet at its deepest spot and 17 29 is under four and one=half feet mean depth. 17 30 (6) Is typically fringed by a border of emergent vegetation 17 31 in water depth less than six feet and when clear is dominated 17 32 by both emergent and submergent vegetation and provides 17 33 important wildlife and fish habitat. 17 34 c. "Significant public lake" means a lake that meets all of 17 35 the following criteria: 18 1 (1) Is owned by the federal government, the state of 18 2 Iowa, a county, or a municipal government, and is maintained 18 3 principally for public use. 18 4 (2) Is a multi=use system capable of supporting diverse 18 5 wildlife, fish, or recreational opportunities. 18 6 (3) Has a surface water area of at least ten acres. 18 7 (4) Does not have a watershed=to=lake surface area ratio of 18 8 greater than two hundred to one. 18 9 (5) Is not an on=stream impoundment that emulates riverine 18 10 habitat rather than a lake environment. 18 11 (6) Is not used solely as a water supply reservoir. 18 12 Sec. 16. Section 456A.33B, subsection 1, paragraph b, Code 18 13 2016, is amended by adding the following new subparagraph: 18 14 NEW SUBPARAGRAPH. (6) When restored, will contribute to the 18 15 department's fish and wildlife conservation plans. 18 16 Sec. 17. Section 456A.33B, subsection 2, paragraphs a and b, 18 17 Code 2016, are amended to read as follows: 18 18 a. The department, with input from stakeholders, shall 18 19developmaintain aninitialannual list of not more than 18 20 thirty=five significant public lakes and not more than five 18 21 public shallow lakes or wetlands to be considered for funding 18 22 based on the feasibility of restoring each lake and the use or 18 23 potential use of the lake, if restored. The list shall include 18 24 lake projects under active development that the department 18 25 shall recommend be given priority for funding so long as 18 26 progress toward completion of the projects remains consistent 18 27 with the goals of this section. 18 28 b. The department shall meet with stakeholders and 18 29 representatives of communities where lakes on theinitial 18 30annual list are located to provide aninitialannual lake 18 31 restoration assessment and to explain the process and criteria 18 32 for receiving lake restoration funding. Communities with 18 33 lakes not included on theinitialannual list may petition the 18 34 director of the department for a preliminary lake restoration 18 35 assessment and explanation of the funding process and criteria. 19 1 The department shall work with stakeholders and representatives 19 2 of each community to develop a joint lake restoration action 19 3 plan. At a minimum, each joint action plan shall document the 19 4 causes, sources, and magnitude of lake impairment, evaluate 19 5 the feasibility of the lake and watershed restoration options, 19 6 establish water quality and fishery and wildlife goals and a 19 7 schedule for attainment, describe long=term management actions, 19 8 assess the economic benefits of the project, identify the 19 9 sources and amounts of any leveraged funds, and describe the 19 10 community's commitment to the project, including local funding. 19 11 The stakeholders' and community's commitment to the project may 19 12 include moneys to fund a lake diagnostic study and watershed 19 13 assessment, including development of a TMDL (total maximum 19 14 daily load). 19 15 Sec. 18. Section 456A.33B, subsection 2, paragraph c, 19 16 subparagraph (2), Code 2016, is amended to read as follows: 19 17 (2) If proposed, dredging of the lake will be conducted to 19 18 a mean depth of at leastteneight feet to gain water quality 19 19 benefits unless a combination of biologic and structural 19 20 controls is sufficient to assure water quality targets will be 19 21 achieved at a shallower average water depth. 19 22 Sec. 19. Section 456A.33B, subsection 2, paragraph d, Code 19 23 2016, is amended to read as follows: 19 24 d. The department shall evaluate the joint action plans 19 25 and prioritize the plans based on the criteria required in 19 26 this section. The department's annual lake restoration plan 19 27 and report shall include the prioritized list and the amounts 19 28 of state and other funding the department recommends for each 19 29 lake restoration project. The departmentmayshall seek public 19 30 comment on its recommendations prior to submitting the plan and 19 31 report to the general assembly. 19 32 Sec. 20. Section 456A.33B, subsection 2, Code 2016, is 19 33 amended by adding the following new paragraph: 19 34 NEW PARAGRAPH. e. The department shall ensure that at least 19 35 eight percent, but no more than twelve percent, of the annual 20 1 appropriation for lake restoration projects in accordance with 20 2 the department's annual lake restoration plan and report shall 20 3 be invested in public shallow lakes or wetlands restoration 20 4 projects. 20 5 DIVISION VI 20 6 MISCELLANEOUS PROVISIONS 20 7 Sec. 21. Section 8.57C, subsection 3, paragraph a, 20 8 subparagraph (2), Code 2016, is amended to read as follows: 20 9 (2) The fiscal year beginning July 1,20162017, and for 20 10 each subsequent fiscal year thereafter. 20 11 Sec. 22. Section 12.79, subsection 3, Code 2016, is amended 20 12 to read as follows: 20 13 3. Moneys in the fund in a fiscal year shall be used as 20 14 appropriated by the general assembly for prison improvement and 20 15 prison construction projects. However, for the fiscal year 20 16 beginning July 1, 2016, any unobligated and unencumbered moneys 20 17 in the fund from the previous fiscal year are appropriated to 20 18 the department of corrections for major maintenance projects. 20 19 Sec. 23. IOWA COMMUNICATIONS NETWORK ==== AUTHORIZATION 20 20 FOR CONTRACTS. Pursuant to section 8D.11, subsection 1, 20 21 paragraph "a", the general assembly authorizes the Iowa 20 22 telecommunications and technology commission to enter into a 20 23 contract or contracts in excess of the contract limitation 20 24 amount established in section 8D.11, subsection 1, paragraph 20 25 "c", for purposes of the commission's network core upgrade 20 26 project. This authorization applies for the duration of the 20 27 commission's project and to all existing or future contracts 20 28 associated with the project, whether or not the award is made 20 29 to a single vendor or multiple vendors. 20 30 Sec. 24. REBUILD IOWA INFRASTRUCTURE FUND ==== LIMITATION ON 20 31 EXPENDITURES. 20 32 1. For purposes of this section, "restricted employee" 20 33 means an elective constitutional or statutory officer, a state 20 34 employee whose salary is set by the governor within a range set 20 35 by the general assembly, or a president of a state board of 21 1 regents institution. 21 2 2. Beginning July 1, 2016, moneys appropriated from the 21 3 rebuild Iowa infrastructure fund and used for public vertical 21 4 infrastructure projects as defined in section 8.57, subsection 21 5 5, paragraph "c", shall not be used for salary or other 21 6 compensation costs of a restricted employee. 21 7 Sec. 25. REBUILD IOWA INFRASTRUCTURE FUND ==== FY 2017=2018 21 8 BUDGET REQUEST INFORMATION. Finalized agency budget requests 21 9 submitted to the governor for the fiscal year beginning 21 10 July 1, 2017, that include a request for an appropriation 21 11 from the rebuild Iowa infrastructure fund to be used for a 21 12 public vertical infrastructure project as defined in section 21 13 8.57, subsection 5, paragraph "c", shall include salary cost 21 14 information as required by this section. The salary cost 21 15 information shall include the number of full=time equivalent 21 16 positions to be utilized for the requested project and that 21 17 portion, in dollars, of salaries and any compensation costs 21 18 attributable to these full=time equivalent positions that will 21 19 be paid from the requested appropriation from the rebuild Iowa 21 20 infrastructure fund. 21 21 Sec. 26. EXECUTIVE COUNCIL ==== PROPERTY ACQUISITION 21 22 AUTHORIZATION. For the fiscal year beginning July 1, 2016, the 21 23 executive council may, in its sole discretion, expend moneys 21 24 as a performance of duty expense pursuant to section 7D.29 to 21 25 provide funding for the acquisition of property located at 525 21 26 East 9th street in the vicinity of the capitol complex. 21 27 Sec. 27. EFFECTIVE UPON ENACTMENT. The following provision 21 28 of this division of this Act, being deemed of immediate 21 29 importance, takes effect upon enactment: 21 30 1.
