1 | AMENDMENT TO HOUSE BILL 3152

2 | AMENDMENT NO. ______. Amend House Bill 3152 on page 15, by | ||||||
3 | replacing lines 15 through 24 with the following: | ||||||
4 | " (b-15) Beginning in 2022, without obtaining any approvals | ||||||
5 | from the Commission or any other agency, regardless of whether | ||||||
6 | any such approval would otherwise be required, each | ||||||
7 | participating utility shall pay the following amounts, as | ||||||
8 | applicable, to the energy low-income and support program, which | ||||||
9 | is intended to fund customer assistance programs with the | ||||||
10 | primary purpose being avoidance of imminent disconnection and | ||||||
11 | reconnecting customers who have been disconnected for | ||||||
12 | nonpayment. A participating utility other than a combination | ||||||
13 | utility shall pay $10,000,000 per year for 10 years, and a | ||||||
14 | participating utility that is a combination utility shall pay | ||||||
15 | $1,000,000 per year for 10 years. Such "; and

3 | by replacing line 9 on page 46 through line 8 on page 47 with | ||||||

5 | "(h) By December 31, 2017, the Commission shall prepare and | ||||||
6 | file with the General Assembly a report on the infrastructure | ||||||
7 | program and the performance-based formula rate. The report | ||||||
8 | shall include the change in the average amount per kilowatthour | ||||||
9 | paid by residential customers between June 1, 2011 and May 31, | ||||||
10 | 2017. If the change in the total average rate paid exceeds 2.5% | ||||||
11 | compounded annually, the Commission shall include in the report | ||||||
12 | an analysis that shows the portion of the change due to the | ||||||
13 | delivery services component and the portion of the change due | ||||||
14 | to the supply component of the rate. The report shall include | ||||||
15 | separate sections for each participating utility. | ||||||
16 | Sections 16-108.5, 16-108.6, 16-108.7, and 16-108.8 of | ||||||
17 | this Act, other than this subsection (h), are inoperative after | ||||||
18 | December 31, 2032 2022 for every participating utility, after | ||||||
19 | which time a participating utility shall no longer be eligible | ||||||
20 | to annually update the performance-based formula rate tariff | ||||||
21 | pursuant to subsection (d) of this Section. At such time, the | ||||||
22 | then current rates shall remain in effect until such time as |

1 | new rates are set pursuant to Article IX of this Act, subject | ||||||
2 | to retroactive adjustment, with interest, to reconcile rates | ||||||
3 | charged with actual costs. | ||||||
4 | The fact that this Section becomes inoperative as set forth | ||||||
5 | in this subsection shall not be construed to mean that the | ||||||
6 | Commission may reexamine or otherwise reopen prudence or | ||||||
7 | reasonableness determinations already made.".
