Bill Title: Amends the Illinois Vehicle Code. Allows the issuance of Lyme disease research decals by the Department of Natural Resources. Provides that $10 of each original issuance and $23 of each renewal shall be deposited into the Tick Research, Education, and Evaluation Fund, and that $15 of each original issuance and $2 of each renewal shall be deposited into the Secretary of State Special License Plate Fund. Provides that money in the Tick Research, Education, and Evaluation Fund shall be paid as grants to the Illinois Lyme Association. Makes a corresponding change in the State Finance Act.

1 AN ACT concerning transportation.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The State Finance Act is amended by adding
5Section 5.990 as follows:
6 (30 ILCS 105/5.990 new)
7 Sec. 5.990. The Tick Research, Education, and Evaluation
8Fund.
9 Section 10. The Illinois Vehicle Code is amended by
10changing Section 3-699.14 as follows:
11 (625 ILCS 5/3-699.14)
12 Sec. 3-699.14. Universal special license plates.
13 (a) In addition to any other special license plate, the
14Secretary, upon receipt of all applicable fees and
15applications made in the form prescribed by the Secretary, may
16issue Universal special license plates to residents of
17Illinois on behalf of organizations that have been authorized
18by the General Assembly to issue decals for Universal special
19license plates. Appropriate documentation, as determined by
20the Secretary, shall accompany each application. Authorized
21organizations shall be designated by amendment to this

1Section. When applying for a Universal special license plate
2the applicant shall inform the Secretary of the name of the
3authorized organization from which the applicant will obtain a
4decal to place on the plate. The Secretary shall make a record
5of that organization and that organization shall remain
6affiliated with that plate until the plate is surrendered,
7revoked, or otherwise cancelled. The authorized organization
8may charge a fee to offset the cost of producing and
9distributing the decal, but that fee shall be retained by the
10authorized organization and shall be separate and distinct
11from any registration fees charged by the Secretary. No decal,
12sticker, or other material may be affixed to a Universal
13special license plate other than a decal authorized by the
14General Assembly in this Section or a registration renewal
15sticker. The special plates issued under this Section shall be
16affixed only to passenger vehicles of the first division,
17including motorcycles and autocycles, or motor vehicles of the
18second division weighing not more than 8,000 pounds. Plates
19issued under this Section shall expire according to the
20multi-year procedure under Section 3-414.1 of this Code.
21 (b) The design, color, and format of the Universal special
22license plate shall be wholly within the discretion of the
23Secretary. Universal special license plates are not required
24to designate "Land of Lincoln", as prescribed in subsection
25(b) of Section 3-412 of this Code. The design shall allow for
26the application of a decal to the plate. Organizations

1authorized by the General Assembly to issue decals for
2Universal special license plates shall comply with rules
3adopted by the Secretary governing the requirements for and
4approval of Universal special license plate decals. The
5Secretary may, in his or her discretion, allow Universal
6special license plates to be issued as vanity or personalized
7plates in accordance with Section 3-405.1 of this Code. The
8Secretary of State must make a version of the special
9registration plates authorized under this Section in a form
10appropriate for motorcycles and autocycles.
11 (c) When authorizing a Universal special license plate,
12the General Assembly shall set forth whether an additional fee
13is to be charged for the plate and, if a fee is to be charged,
14the amount of the fee and how the fee is to be distributed.
15When necessary, the authorizing language shall create a
16special fund in the State treasury into which fees may be
17deposited for an authorized Universal special license plate.
18Additional fees may only be charged if the fee is to be paid
19over to a State agency or to a charitable entity that is in
20compliance with the registration and reporting requirements of
21the Charitable Trust Act and the Solicitation for Charity Act.
22Any charitable entity receiving fees for the sale of Universal
23special license plates shall annually provide the Secretary of
24State a letter of compliance issued by the Attorney General
25verifying that the entity is in compliance with the Charitable
26Trust Act and the Solicitation for Charity Act.

1 (d) Upon original issuance and for each registration
2renewal period, in addition to the appropriate registration
3fee, if applicable, the Secretary shall collect any additional
4fees, if required, for issuance of Universal special license
5plates. The fees shall be collected on behalf of the
6organization designated by the applicant when applying for the
7plate. All fees collected shall be transferred to the State
8agency on whose behalf the fees were collected, or paid into
9the special fund designated in the law authorizing the
10organization to issue decals for Universal special license
11plates. All money in the designated fund shall be distributed
12by the Secretary subject to appropriation by the General
13Assembly.
14 (e) The following organizations may issue decals for
15Universal special license plates with the original and renewal
16fees and fee distribution as follows:
17 (1) The Illinois Department of Natural Resources.
18 (A) Original issuance: $25; with $10 to the
19 Roadside Monarch Habitat Fund and $15 to the Secretary
20 of State Special License Plate Fund.
21 (B) Renewal: $25; with $23 to the Roadside Monarch
22 Habitat Fund and $2 to the Secretary of State Special
23 License Plate Fund.
24 (2) Illinois Veterans' Homes.
25 (A) Original issuance: $26, which shall be
26 deposited into the Illinois Veterans' Homes Fund.

1 (B) Renewal: $26, which shall be deposited into
2 the Illinois Veterans' Homes Fund.
3 (3) The Illinois Department of Human Services for
4 volunteerism decals.
5 (A) Original issuance: $25, which shall be
6 deposited into the Secretary of State Special License
7 Plate Fund.
8 (B) Renewal: $25, which shall be deposited into
9 the Secretary of State Special License Plate Fund.
10 (4) The Illinois Department of Public Health.
11 (A) Original issuance: $25; with $10 to the
12 Prostate Cancer Awareness Fund and $15 to the
13 Secretary of State Special License Plate Fund.
14 (B) Renewal: $25; with $23 to the Prostate Cancer

17 (f) The following funds are created as special funds in
18the State treasury:
19 (1) The Roadside Monarch Habitat Fund. All money in
20 the Roadside Monarch Habitat Fund shall be paid as grants
21 to the Illinois Department of Natural Resources to fund
22 roadside monarch and other pollinator habitat development,
23 enhancement, and restoration projects in this State.
24 (2) The Prostate Cancer Awareness Fund. All money in
25 the Prostate Cancer Awareness Fund shall be paid as grants
26 to the Prostate Cancer Foundation of Chicago.

1 (3) The Horsemen's Council of Illinois Fund. All money
2 in the Horsemen's Council of Illinois Fund shall be paid
3 as grants to the Horsemen's Council of Illinois.
4 (4) The Post-Traumatic Stress Disorder Awareness Fund.
5 All money in the Post-Traumatic Stress Disorder Awareness
6 Fund shall be paid as grants to K9s for Veterans, NFP for
7 support, education, and awareness of veterans with
8 post-traumatic stress disorder.
9 (5) The Guide Dogs of America Fund. All money in the
10 Guide Dogs of America Fund shall be paid as grants to the
11 International Guiding Eyes, Inc., doing business as Guide
12 Dogs of America.
13 (6) The Mechanics Training Fund. All money in the
14 Mechanics Training Fund shall be paid as grants to the
15 Mechanics Local 701 Training Fund.
16 (7) The Theresa Tracy Trot - Illinois CancerCare
17 Foundation Fund. All money in the Theresa Tracy Trot -
18 Illinois CancerCare Foundation Fund shall be paid to the
19 Illinois CancerCare Foundation for the purpose of
20 furthering pancreatic cancer research.
21 (8) The Developmental Disabilities Awareness Fund. All
22 money in the Developmental Disabilities Awareness Fund
23 shall be paid as grants to the Illinois Department of
24 Human Services to fund legal aid groups to assist with
25 guardianship fees for private citizens willing to become
26 guardians for individuals with developmental disabilities

1 but who are unable to pay the legal fees associated with
2 becoming a guardian.
3 (9) The Pediatric Cancer Awareness Fund. All money in
4 the Pediatric Cancer Awareness Fund shall be paid as
5 grants to the Cancer Center at Illinois for pediatric
6 cancer treatment and research.
7 (10) The Folds of Honor Foundation Fund. All money in
8 the Folds of Honor Foundation Fund shall be paid as grants
9 to the Folds of Honor Foundation to aid in providing
10 educational scholarships to military families.
11 (11) The Experimental Aircraft Association Fund. All
12 money in the Experimental Aircraft Association Fund shall
13 be paid, subject to appropriation by the General Assembly
14 and distribution by the Secretary, as grants to promote
15 recreational aviation.
16 (12) The Child Abuse Council of the Quad Cities Fund.
17 All money in the Child Abuse Council of the Quad Cities
18 Fund shall be paid as grants to benefit the Child Abuse
19 Council of the Quad Cities.
20 (13) The Illinois Health Care Workers Benefit Fund.
21 All money in the Illinois Health Care Workers Benefit Fund
22 shall be paid as grants to the Trinity Health Foundation
23 for the benefit of health care workers, doctors, nurses,
24 and others who work in the health care industry in this
25 State.
26 (14) The Future Farmers of America Fund. All money in

1 the Future Farmers of America Fund shall be paid as grants
2 to the Illinois Association of Future Farmers of America.
3 (15) The Tick Research, Education, and Evaluation
4 Fund. All money in the Tick Research, Education, and
5 Evaluation Fund shall be paid as grants to the Illinois
6 Lyme Association.
