Bill Title: Amends the Counties Code. Requires that in the event that no family can reasonably be found, a coroner must wait at least 60 days before causing a body or remains to be buried, cremated, or donated for medical science purposes. Effective immediately.

1 | AN ACT concerning local government.
| ||||||||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||
3 | represented in the General Assembly:
| ||||||||||||||||||||||||
4 | Section 5. The Counties Code is amended by changing Section | ||||||||||||||||||||||||
5 | 3-3034 as follows:

7 | Sec. 3-3034. Disposition of body. After the inquest the | ||||||||||||||||||||||||
8 | coroner
may deliver the body or human remains of the deceased | ||||||||||||||||||||||||
9 | to the family of the deceased or, if there are no family | ||||||||||||||||||||||||
10 | members to accept the body or the remains, then to friends of | ||||||||||||||||||||||||
11 | the deceased, if there be any, but
if not, the coroner shall | ||||||||||||||||||||||||
12 | cause the body or the remains to be decently buried, cremated, | ||||||||||||||||||||||||
13 | or donated for medical science purposes, the expenses to be | ||||||||||||||||||||||||
14 | paid
from the property of the deceased, if there is sufficient, | ||||||||||||||||||||||||
15 | if not, by the
county. The coroner shall not cause a body or | ||||||||||||||||||||||||
16 | remains to be buried, cremated, or donated for medical science | ||||||||||||||||||||||||
17 | purposes until at least 60 days after a reasonable attempt has | ||||||||||||||||||||||||
18 | been made to locate the family of the deceased. The coroner may | ||||||||||||||||||||||||
19 | not approve the cremation or donation of the body if it is | ||||||||||||||||||||||||
20 | necessary to preserve the body for law enforcement purposes. If | ||||||||||||||||||||||||
21 | the State Treasurer, pursuant to the Uniform Disposition of | ||||||||||||||||||||||||
22 | Unclaimed Property Act, delivers human remains to the coroner, | ||||||||||||||||||||||||
23 | the coroner shall cause the human remains to be disposed of as |
