750 ILCS 95/25

Amends the Frail Elderly Individual Family Visitation Protection Act. Deletes language providing that the Act does not apply if the family caregiver is acting as agent under a power of attorney or acting at the direction of an agent under a power of attorney pursuant to the Illinois Power of Attorney Act.

1 AN ACT concerning civil law.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Frail Elderly Individual Family Visitation
5Protection Act is amended by changing Section 25 as follows:
6 (750 ILCS 95/25)
7 Sec. 25. Applicability. This Act does not apply if: (i) the
8frail elderly individual is a person under guardianship
9pursuant to Article XIa of the Probate Act of 1975; or (ii) the
10family caregiver is acting as agent under a power of attorney
11or acting at the direction of an agent under a power of
12attorney pursuant to the Illinois Power of Attorney Act.
