1 | HOUSE RESOLUTION
| ||||||
2 | WHEREAS, On June 22, 1999, in Olmstead v. L.C., the United | ||||||
3 | States Supreme Court held that the unjustified segregation of | ||||||
4 | persons with disabilities constitutes discrimination in | ||||||
5 | violation of Title II of the Americans with Disabilities Act; | ||||||
6 | and
| ||||||
7 | WHEREAS, The Olmstead ruling held that a person with a | ||||||
8 | disability has the right to receive State-funded services and | ||||||
9 | supports in the community rather than in an institution when | ||||||
10 | the person's treatment professionals determine that the person | ||||||
11 | is appropriate for community-based services, the person is not | ||||||
12 | opposed to community-based services, and the provision of | ||||||
13 | community-based services to the individual is a reasonable | ||||||
14 | accommodation and not a fundamental alteration of the State's | ||||||
15 | services; and

16 | WHEREAS, In 2011, the State of Illinois entered into a | ||||||
17 | consent decree in settlement of the Ligas class action lawsuit | ||||||
18 | that was based upon the Olmstead decision and filed on behalf | ||||||
19 | of a class of persons with developmental disabilities who were | ||||||
20 | residing in private, State-funded facilities of nine or more | ||||||
21 | persons or who were at risk of being placed in such facilities; | ||||||
22 | and

1 | WHEREAS, Illinois ranks 47th out of 50 states in annual | ||||||
2 | spending for community-based services and supports; and
| ||||||
3 | WHEREAS, Illinois has the second highest number of persons | ||||||
4 | with intellectual or developmental disabilities living in | ||||||
5 | institutions, exceeded only by Texas; and
| ||||||
6 | WHEREAS, Almost 20,000 persons with intellectual or | ||||||
7 | developmental disabilities are on the waiting list for | ||||||
8 | developmental disabilities services in Illinois, including | ||||||
9 | almost 7,500 who want services immediately; and
| ||||||
10 | WHEREAS, The Going Home Coalition is a statewide Illinois | ||||||
11 | network of self-advocates, family members, educators, | ||||||
12 | advocates, and community leaders who support person-centered | ||||||
13 | and responsive programs and systems that ensure persons with | ||||||
14 | disabilities in Illinois the opportunity to live full and | ||||||
15 | dignified lives in their own homes with full integration into | ||||||
16 | their communities; and
| ||||||
17 | WHEREAS, The Going Home Coalition commemorates the 20th | ||||||
18 | anniversary of the Olmstead decision on June 22, 2019; and
| ||||||
19 | WHEREAS, Twenty years after Olmstead, the State of Illinois | ||||||
20 | continues to isolate and segregate persons with intellectual or | ||||||
21 | developmental disabilities to a higher degree than most other |

1 | states; therefore, be it
| ||||||
2 | RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE ONE | ||||||
3 | HUNDRED FIRST GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that | ||||||
4 | we declare June 22, 2019 as Olmstead 20th Anniversary Day in | ||||||
5 | the State of Illinois, and we urge the citizens of Illinois to | ||||||
6 | recognize that day and be aware of its significance to persons | ||||||
7 | with disabilities in Illinois; and be it further
| ||||||
8 | RESOLVED, That a suitable copy of this resolution be | ||||||
9 | presented to the Going Home Coalition as a symbol of our | ||||||
10 | respect and esteem.
