Bill Title: Amends the Illinois Municipal Code. Provides that the corporate authorities of each municipality may use a utility pole within its public rights-of-way for municipal public safety purposes, including, but not limited to, the placing of equipment associated with public safety. Provides that any fee charged for the use of a utility pole under the Section shall be at the lowest rate charged by the entity owing the utility pole and shall not exceed the entity's actual costs. Amends the Public Utilities Act to make conforming changes.

AN ACT concerning local government.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Illinois Municipal Code is amended by
adding Section 11-80-25 as follows:
(65 ILCS 5/11-80-25 new)
Sec. 11-80-25. Municipal use of utility pole for municipal
public safety.
(a) The corporate authorities of a municipality may use a
utility pole within its public rights-of-way for municipal
public safety purposes, including, but not limited to, the
placing of equipment associated with public safety.
(b) Any fee charged for the use of a utility pole under
this Section shall be at the lowest rate charged by the entity
owning the utility pole and shall not exceed the entity's
actual costs.
Section 10. The Public Utilities Act is amended by adding
Section 8-513 as follows:

Sec. 8-513. Utility obligations for municipal public
safety. Public utilities and telecommunication carriers shall

provide municipalities with the use of any utility pole within
the municipality's public rights-of-way as provided in Section
11-80-24 of the Illinois Municipal Code.
