Bill Title: Amends the Illinois Municipal Code. Provides that the corporate authorities of each municipality may use a utility pole within its public rights-of-way for municipal public safety purposes, including, but not limited to, the placing of equipment associated with public safety. Provides that any fee charged for the use of a utility pole under the Section shall be at the lowest rate charged by the entity owing the utility pole and shall not exceed the entity's actual costs. Amends the Public Utilities Act to make conforming changes.

1 AN ACT concerning local government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Illinois Municipal Code is amended by
5adding Section 11-80-25 as follows:
6 (65 ILCS 5/11-80-25 new)
7 Sec. 11-80-25. Municipal use of utility pole for municipal
8public safety.
9 (a) The corporate authorities of a municipality may use a
10utility pole within its public rights-of-way for municipal
11public safety purposes, including, but not limited to, the
12placing of equipment associated with public safety.
13 (b) Any fee charged for the use of a utility pole under
14this Section shall be at the lowest rate charged by the entity
15owning the utility pole and shall not exceed the entity's
16actual costs.
17 Section 10. The Public Utilities Act is amended by adding
18Section 8-513 as follows:

20 Sec. 8-513. Utility obligations for municipal public
21safety. Public utilities and telecommunication carriers shall

311-80-24 of the Illinois Municipal Code.
