Provides that the paperwork required to obtain a building permit must still be submitted. Limits home rule powers. Effective January 1, 2024.

1 AN ACT concerning local government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Counties Code is amended by adding Section
55-12022 as follows:
6 (55 ILCS 5/5-12022 new)
7 Sec. 5-12022. Disabled veteran building permit fee.
8 (a) A disabled veteran or the disabled veteran's caregiver
9shall not be charged any building permit fee for improvements
10to the residence of the disabled veteran if the improvements
11are required to accommodate a disability of the veteran.
12Nothing in this subsection changes the obligation of any
13person to submit to the county applications, forms, or other
14paperwork to obtain a building permit.
15 (b) A home rule county may not regulate building permit
16fees in a manner inconsistent with this Section. This Section
17is a limitation under subsection (i) of Section 6 of Article
18VII of the Illinois Constitution on the concurrent exercise by
19home rule units of powers and functions exercised by the
20State.
21 Section 10. The Township Code is amended by adding Section
22110-17 as follows:

2 Sec. 110-17. Disabled veteran building permit fee. A
3disabled veteran or the disabled veteran's caregiver shall not
4be charged any building permit fee for improvements to the
5residence of the disabled veteran if the improvements are
6required to accommodate a disability of the veteran. Nothing
7in this Section changes the obligation of any person to submit
8to the township applications, forms, or other paperwork to
9obtain a building permit.
10 Section 15. The Illinois Municipal Code is amended by
11adding Section 11-13-28 as follows:
12 (65 ILCS 5/11-13-28 new)
13 Sec. 11-13-28. Disabled veteran building permit fee.
14 (a) A disabled veteran or the disabled veteran's caregiver
15shall not be charged any building permit fee for improvements
16to the residence of the disabled veteran if the improvements
17are required to accommodate a disability of the veteran.
18Nothing in this subsection changes the obligation of any
19person to submit to the municipality applications, forms, or
20other paperwork to obtain a building permit.
21 (b) A home rule municipality may not regulate building
22permit fees in a manner inconsistent with this Section. This
23Section is a limitation under subsection (i) of Section 6 of

1Article VII of the Illinois Constitution on the concurrent

3by the State.
4 Section 99. Effective date. This Act takes effect January
51, 2024.
