Bill Title: Amends the School Code. Provides that prior to approving a new contract for any district-administered assessment, the school board must hold a public vote at a regular meeting of the school board, at which the terms of the proposal must be substantially presented and an opportunity for allowing public comments must be provided, subject to applicable notice requirements. Provides that if the assessment being made available to review is subject to copyright, trademark, or other intellectual property protection, the review process shall include technical and procedural safeguards to ensure that the materials are not able to be widely disseminated to the general public in violation of the intellectual property rights of the publisher and to ensure content validity is not undermined. Effective July 1, 2024.

SYNOPSIS AS INTRODUCED:

Amends the School Code. Provides that prior to approving a contract for any district-administered assessment, except those assessments developed by district teachers or administrators, that will be used to measure student progress at an attendance center within the school district, a school board must hold a public hearing at a regular or special meeting of the school board, in which the terms of the proposal must be substantially presented and an opportunity for allowing public comments must be provided. Provides that notice of such public hearing must be provided at least 10 days prior to the hearing by specified methods. Effective immediately.

1 AN ACT concerning education.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The School Code is amended by adding Sections
510-20.85 and 34-18.82 as follows:
6 (105 ILCS 5/10-20.85 new)
7 Sec. 10-20.85. Community input on local assessments. Prior
8to approving a contract for any district-administered
9assessment, except those assessments developed by district
10teachers or administrators, that will be used to measure
11student progress at an attendance center within the school
12district, a school board must hold a public hearing at a
13regular or special meeting of the school board, in which the
14terms of the proposal must be substantially presented and an
15opportunity for allowing public comments must be provided.
16Notice of such public hearing must be provided at least 10 days
17prior to the hearing by:
18 (1) publication in a newspaper of general circulation
19 in the school district;
20 (2) written or electronic notice designed to reach the
21 parents or guardians of all students enrolled in the
22 school district; and
23 (3) written or electronic notice designed to reach any

1 exclusive collective bargaining representatives of school
2 district employees and all those employees not in a
3 collective bargaining unit.
