Bill Title: Amends the School Code. Provides that each school board must not (1) make available to a student any food or beverage that contains any amount of industrially produced trans fat or (2) use a food that contains any industrially produced trans fat in the preparation of a food item or beverage that is intended for consumption by a student. Provides that the prohibition applies to all food and beverages made available to a student on school grounds during each school day and extended school day, including, but not limited to, a food or beverage item made available to a student in a school cafeteria, school store, vending machine, or other food service entity existing upon school grounds or through any fundraising effort conducted by one or more students, teachers, or parents. Provides that the prohibition does not apply to any food or beverage that is made available to a student as part of a meal program of the United States Department of Agriculture.

2 | AMENDMENT NO. ______. Amend Senate Bill 3408 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The School Code is amended by adding Sections | ||||||
5 | 10-20.55 and 34-18.47 as follows:

6 | (105 ILCS 5/10-20.55 new) | ||||||
7 | Sec. 10-20.55. Prohibition on industrially produced trans | ||||||
8 | fat. | ||||||
9 | (a) For purposes of this Section: | ||||||
10 | "Food containing industrially produced trans fat" means a | ||||||
11 | food that contains vegetable shortening, margarine, or any kind | ||||||
12 | of partially hydrogenated vegetable oil, unless the | ||||||
13 | manufacturer's documentation or the label required on the food, | ||||||
14 | pursuant to applicable federal laws and regulations, lists the | ||||||
15 | trans fat content as zero grams of trans fat per serving. | ||||||
16 | "School food service establishment" means a place that |

1 | regularly sells or serves a food item or meal on a school | ||||||
2 | campus. | ||||||
3 | (b) Each school district must not make available food | ||||||
4 | containing industrially produced trans fat or use food | ||||||

10 | (c) Subsection (b) of this Section applies to all food and | ||||||
11 | beverages sold on school grounds during the regular and | ||||||
12 | extended school day. The extended school day shall include | ||||||
13 | activities such as clubs, yearbook, band and choir practice, | ||||||
14 | student government, drama, and childcare and latchkey | ||||||
15 | programs. | ||||||
16 | (d) This Section does not apply to food provided through a | ||||||
17 | United States Department of Agriculture meal program, packaged | ||||||
18 | items used for fundraising, or food or beverages provided by | ||||||
19 | parents or guardians. This Section does not apply to activities | ||||||
20 | or programs organized and supervised by a private or | ||||||
21 | not-for-profit organization on school premises.
