A SENATE RESOLUTION urging the Legislative Council to assign an interim study committee the topic of extraterritorial jurisdiction granted to municipalities under IC 36-9-2-19.

MADAM PRESIDENT:
I offer the following resolution and move its adoption:
A SENATE RESOLUTION urging the Legislative Council to
assign an interim study committee the topic of extraterritorial
jurisdiction granted to municipalities under IC 36-9-2-19.
Whereas, Municipalities have authority to regulate
conduct on property as much as ten miles outside the
corporate boundaries under IC 36-9-2-19;
Whereas, Indiana citizens who reside outside those
corporate boundaries have no representation in the
municipal bodies that adopt the ordinances;
Whereas, Many of these powers are also vested in other
units of state and local government; and
Whereas, It would be prudent to study the impact of this
redundant authority on nonmunicipal residents and
businesses: Therefore,
SECTION 1. That the Indiana Senate urges the Legislative
Council to assign an interim study committee the topic of
extraterritorial jurisdiction granted to municipalities under
IC 36-9-2-19.
