Summary
Amend KRS 342.610 to eliminate the presumption of intoxication proximately causing the employee's injury and allow an administrative law judge to consider whether an employee's intoxication by illegal, nonprescribed substance or substances or prescribed substance or substances in amounts in excess of prescribed amounts proximately caused the injury when determining an employer's liability for workers' compensation.
