HOUSE BILL NO. 4589

May 16, 2023, Introduced by Reps. Aragona and Bierlein and referred to the Committee on Government Operations.

A bill to amend 1947 PA 336, entitled

"An act to prohibit strikes by certain public employees; to provide review from disciplinary action with respect thereto; to provide for the mediation of grievances and the holding of elections; to declare and protect the rights and privileges of public employees; to require certain provisions in collective bargaining agreements; to prescribe means of enforcement and penalties for the violation of the provisions of this act; and to make appropriations,"

(MCL 423.201 to 423.217) by adding section 10a.

the people of the state of michigan enact:

Sec. 10a. (1) A bargaining representative shall not use dues or fees collected from a public employee for a political purpose unless both of the following conditions are met:

(a) The public employee gives the bargaining representative explicit authorization, in writing, to use the public employee's dues or fees for a political purpose.

(b) The public employee has not revoked the public employee's authorization.

(2) A bargaining representative shall maintain a public employee's written authorization under subsection (1) until the later of the following:

(a) One year after the date the public employee is no longer a member of the bargaining representative.

(b) One year after the date the public employee is no longer a member of the bargaining unit that the bargaining representative represents.

(c) One year after the date the public employee revokes the public employee's authorization.

(3) As used in this section, "political purpose" means support for or opposition to any of the following:

(a) A ballot question or ballot question committee as those terms are defined in section 2 of the Michigan campaign finance act, 1976 PA 388, MCL 169.202.

(b) A political committee, political party, or political party committee as those terms are defined in section 11 of the Michigan campaign finance act, 1976 PA 388, MCL 169.211.
