Substitute For

HOUSE BILL NO. 4930

A bill to amend 1990 PA 187, entitled

"The pupil transportation act,"

by amending sections 5 and 20 (MCL 257.1805 and 257.1820), section 5 as amended by 2006 PA 107 and section 20 as added by 2021 PA 52.

the people of the state of michigan enact:

Sec. 5. (1) "Law enforcement agency" means that term as defined in section 682 of the Michigan vehicle code, 1949 PA 300, MCL 257.682.

(2) "Motor bus" means bus and "motor carrier of passengers" mean means motor carrier as those terms as are defined in section 3 of the motor bus transportation act, 1982 PA 432, MCL 474.103.

(3) (2) "Nonpublic school" means that term as defined in section 5 of the revised school code, 1976 PA 451, MCL 380.5.

(4) (3) "Public school" means that term as defined in section 5 of the revised school code, 1976 PA 451, MCL 380.5.

(5) (4) "Rule" means a rule promulgated pursuant to the administrative procedures act of 1969, 1969 PA 306, MCL 24.201 to 24.328.

(6) (5) "School" means either a public school or a nonpublic school, or both.

(7) "School district" means that term as defined in section 6 of the revised school code, 1976 PA 451, MCL 380.6.

(8) "Stop-arm camera system" means a system of 2 or more cameras affixed to a school bus that meets all of the following requirements:

(a) Is synchronized to automatically record video or 1 or more sequenced photographs of a vehicle that fails to stop for a school bus or passes a school bus in violation of section 682(1) of the Michigan vehicle code, 1949 PA 300, MCL 257.682.

(b) Is capable of capturing images of both of the following:

(i) The vehicle.

(ii) The registration plate on the rear of the vehicle.

(c) Records the date, time, and location on a video recorded or photograph captured by the system.

Sec. 20. (1) A school bus may be equipped with a stop-arm camera system in accordance with this section.

(2) A school district may do either any of the following:

(a) Install and operate a stop-arm camera system on a school bus.

(b) Enter into an agreement with 1 or more law enforcement agencies that establishes enforcement responsibilities for and the reimbursement of any costs related to a camera-based violation of section 682(1) of the Michigan vehicle code, 1949 PA 300, MCL 257.682.

(c) (b) Enter into a contract with a private vendor to install and do 1 or more of the following:

(i) Install, operate, and provide support to a stop-arm camera system on a school bus.

(3) As used in this section, "stop-arm camera system" means a system of 2 or more cameras affixed to a school bus that meets all of the following requirements:

(a) Is synchronized to automatically record video or 1 or more sequenced photographs of a vehicle failing to stop for a school bus or passing a school bus in violation of section 682(1) of the Michigan vehicle code, 1949 PA 300, MCL 257.682.

(b) Is capable of capturing images of all of the following:

(i) The vehicle.

(ii) The registration plate on the rear of the vehicle.

(iii) A distance of not less than 200 feet in front of the school bus.

(c) Records the date, time, and location on an image produced by the system.

(ii) Perform the school district's obligations under an agreement described in subdivision (b) on behalf of the school district.

(3) If required by a contract entered into under subsection (2), a private vendor operating a stop-arm camera system shall provide all of the following information to a law enforcement agency authorized to enforce section 682(1) of the Michigan vehicle code, 1949 PA 300, MCL 257.682, if the stop-arm camera system captures a photograph or records video showing an alleged violation of section 682(1) of the Michigan vehicle code, 1949 PA 300, MCL 257.682:

(a) A copy of the photograph captured or video recorded showing the motor vehicle.

(b) The registration plate number and state of issuance of the registration plate.

(c) The date, time, and place of the alleged violation.

Enacting section 1. This amendatory act does not take effect unless all of the following bills of the 102nd Legislature are enacted into law:

(a) House Bill No. 4928.

(b) House Bill No. 4929.
