Substitute For

HOUSE BILL NO. 4981

A bill to amend 1954 PA 116, entitled

"Michigan election law,"

by amending section 191 (MCL 168.191), as amended by 2018 PA 120.

the people of the state of michigan enact:

Sec. 191. (1) A person Subject to subsection (2), an individual is not eligible to the office of county clerk, county treasurer, register of deeds, prosecuting attorney, sheriff, drain commissioner, or surveyor , or coroner if the person individual is not a registered and qualified elector of the county in which election is sought by the filing deadline.

(2) Except as otherwise provided in subsection (3), in addition to the requirements under subsection (1), an individual is not eligible to the office of county sheriff unless that individual meets at least 1 of the following:

(a) Has been a law enforcement officer licensed under the Michigan commission on law enforcement standards act, 1965 PA 203, MCL 28.601 to 28.615, for 5 years or more.

(b) Has been a local corrections officer, as that term is defined in section 2 of the local corrections officers training act, 2003 PA 125, MCL 791.532, for 5 years or more and has been certified by the sheriffs coordinating and training council, as described in section 4 of the local corrections officers training act, 2003 PA 125, MCL 791.534.

(3) The requirement in subsection (2) does not apply to an individual who is a county sheriff on the effective date of the amendatory act that added this subsection.
