HOUSE BILL No. 5138

 

November 1, 2011, Introduced by Reps. Nesbitt, Kurtz, Muxlow, Foster, Glardon, Wayne Schmidt, Roy Schmidt, Kowall and Liss and referred to the Committee on Transportation.

 

     A bill to amend 1949 PA 300, entitled

 

"Michigan vehicle code,"

 

(MCL 257.1 to 257.923) by adding section 822.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 822. (1) An individual who owns or leases a motor vehicle

 

in this state may apply, on a form prescribed by the secretary of

 

state, to participate in the yellow dot program.

 

     (2) The secretary of state shall provide all of the following

 

to an applicant for the yellow dot program:

 

     (a) A window decal in a form substantially similar to that

 

used by other states that have implemented a yellow dot program.

 

     (b) An informational form with spaces for an applicant to

 

provide all of the following information:

 

     (i) The applicant's name.

 

     (ii) The applicant's emergency contact information.


 

     (iii) The names of the applicant's physicians and contact

 

information for those physicians.

 

     (iv) The applicant's medical conditions.

 

     (v) Whether the applicant has had any surgeries and, if so,

 

the types and dates of those surgeries.

 

     (vi) The applicant's allergies, if any.

 

     (vii) Whether the applicant is using any medications and, if

 

so, the types and dosages of those medications.

 

     (c) An identifying photograph of the applicant, to be provided

 

by the applicant at the time the application is made.

 

     (d) A folder clearly marked with the phrase "yellow dot

 

program" of an adequate size to hold the informational form and

 

photograph described in subdivisions (b) and (c).

 

     (3) An applicant who receives the materials listed in

 

subsection (2) may affix the yellow dot program window decal to the

 

driver's side of the vehicle's front windshield in the lower

 

corner. The applicant may place the materials described in

 

subsection (2)(b) to (c) in the folder provided under subsection

 

(2)(d) and may place the folder in his or her vehicle's glove

 

compartment.

 

     (4) A properly placed yellow dot program window decal on a

 

vehicle involved in an accident or other emergency shall serve as

 

notice to a first responder assisting the vehicle that the

 

vehicle's owner or lessee is a participant in the yellow dot

 

program, and the first responder shall remove the folder described

 

in subsection (2)(d) from the vehicle's glove compartment as soon

 

as practicable under the circumstances of the accident or


 

emergency.

 

     (5) The secretary of state shall not charge a fee to an

 

applicant for participation in the yellow dot program. The

 

secretary of state may accept donations and grants from any source

 

to assist in paying expenses incurred by the secretary of state in

 

administering the yellow dot program.

 

     (6) As used in this section:

 

     (a) "First responder" means a police officer, firefighter,

 

ambulance personnel, or any other individual who, in the course of

 

his or her employment, is dispatched to the scene of vehicle

 

accidents or emergencies for the purpose of providing assistance or

 

medical care.

 

     (b) "Yellow dot program" means the program designed to assist

 

citizens of this state and first responders in the event of a crash

 

or other medical emergency involving a vehicle described in this

 

section.
