HOUSE BILL NO. 5377

November 14, 2023, Introduced by Reps. Meerman, Borton, Slagh, Prestin, Alexander, Johnsen and Bierlein and referred to the Committee on Judiciary.

A bill to amend 1846 RS 66, entitled

"Of estates in dower, by the curtesy, and general provisions concerning real estate,"

(MCL 554.131 to 554.139) by adding section 40.

the people of the state of michigan enacT:

Sec. 40. (1) A person that owns or occupies real property and that entirely or partially designates the property as a gun-free or weapon-free zone is responsible for the safety of an individual who enters the gun-free or weapon-free zone.

(2) A person that owns or occupies real property as described in subsection (1) is liable in a civil action for damages that result from injuries that an individual sustains in the gun-free or weapon-free zone if the person failed to provide adequate security in the gun-free or weapon-free zone.

(3) As used in this section, "person" means an individual, partnership, corporation, association, governmental entity, or other legal entity.

Enacting section 1. This amendatory act does not take effect unless Senate Bill No.____ or House Bill No. 5381 (request no. 03965'23 a) of the 102nd Legislature is enacted into law.
