HOUSE BILL No. 5594

     A bill to amend 1994 PA 451, entitled

 

"Natural resources and environmental protection act,"

 

(MCL 324.101 to 324.90106) by adding section 5519.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 5519. (1) Subject to subsection (3), by March 1 annually,

 

the department shall prepare and submit to the legislature a report

 

that includes the following related to the department's asbestos

 

program:

 

     (a) For the previous calendar year, all of the following:

 

     (i) The number of inspectors employed by the department.

 

     (ii) The number of inspections conducted.

 

     (iii) The percentage of inspections conducted per

 

notifications received.


     (iv) The number of enforcement actions taken.

 

     (b) An assessment and recommendation of whether the department

 

has a sufficient number of inspectors to carry out the asbestos

 

national emissions standards for hazardous air pollutants program

 

under section 112 of title I of the clean air act, 42 USC 7412. The

 

evaluation of sufficiency under this subdivision shall be based

 

upon metrics established by the department for the percentage of

 

inspections conducted each year per initial notices of intent to

 

renovate or demolish that are received that year. The minimum

 

percentage set by the department for a determination of sufficiency

 

shall be at least 15%.

 

     (2) Prior to finalizing the report under subsection (1), the

 

department shall hold a public hearing to outline its assessment

 

and to take testimony on its proposed recommendations. The public

 

hearing shall be held in compliance with the open meetings act,

 

1976 PA 275, MCL 15.261 to 15.275.

 

     (3) The report prepared under subsection (1) shall be posted

 

on the department's website and published in the Michigan Register.

 

     (4) The report required under subsection (1) may be combined

 

with the report required under section 5522.

 

     Enacting section 1. This amendatory act takes effect 90 days

 

after the date it is enacted into law.
