provisions concerning appropriations

GENERAL SECTIONS

Sec. 201. Pursuant to section 30 of article IX of the state constitution of 1963, total state spending from state sources under part 1 for the fiscal year ending September 30, 2020 is $6,000,000.00 and total state spending from state sources to be paid to local units of government is $6,000,000.00.

Sec. 202. The appropriations made and expenditures authorized under this part and the departments, commissions, boards, offices, and programs for which appropriations are made under this part and part 1 are subject to the management and budget act, 1984 PA 431, MCL 18.1101 to 18.1594.

Sec. 203. If the state administrative board, acting under section 3 of 1921 PA 2, MCL 17.3, transfers funds from an amount appropriated under this act, the legislature may, by a concurrent resolution adopted by a majority of the members elected to and serving in each house, inter-transfer funds within this act for the particular department, board, commission, office, or institution.

 

DEPARTMENT OF STATE POLICE

Sec. 301. Funds appropriated in part 1 from the disaster and emergency contingency fund shall be allocated to a county with a population of more than 80,000 and less than 85,000, to a county with a population of more than 200,000 and less than 205,000, to a county with a population of more than 15,000 and less than 16,000, to a county with a population of more than 25,600 and less than

25,700, to a county with a population of more than 25,800 and less than 25,900, and to a city with a population of more than 35,000 located in a county with a population of more than 80,000 and less than 85,000, according to the most recent federal decennial census. Funding shall be used to support housing assistance costs for individuals displaced from their residence and to reimburse project restoration costs and expenses caused by the disaster impacting those counties. Restoration projects include, but are not limited to, debris removal, emergency protective measures such as road blockades, sheltering, and evacuations, chemical contamination clean-up efforts, and the repair of real estate and personal property. Expenditures for chemical contamination clean-up efforts shall not be made for projects where existing parties are responsible for monitoring and remediating contaminated properties.

Sec. 302. The department of state police shall seek reimbursement for flood-related expenditures made from the appropriation in part 1 from the disaster and emergency contingency fund in the event that a court finds that those expenditures have been used to facilitate unlawful conduct.

Sec. 303. By September 30, 2020, the department of state police shall submit a report to the senate and house appropriations committees and the senate and house fiscal agencies that includes all of the following information:

(a) Name and location of any entity that received funding from the disaster and emergency contingency fund for costs related to the Edenville and Sanford dam incidents.

(b) Purpose and use of each expenditure that was made.

(c) Amount of federal funding that was provided for flood response related to the Edenville and Sanford dam incidents and an

itemization of any expenses covered by the disaster and emergency contingency fund related to these incidents that are eligible for reimbursement.

(d) Status of any programs that received support from the disaster and emergency contingency fund due to the Edenville and Sanford dam incidents.

(e) Job titles and number of state full-time equated positions, by department, that were engaged in responding to the Edenville and Sanford dam incidents.

(f) Listing of all local and county units that applied for disaster and emergency contingency fund assistance grants and the determination that was made on each of the applications.
