HOUSE BILL No. 5906

 

 

September 21, 2016, Introduced by Rep. Chatfield and referred to the Committee on Judiciary.

 

     A bill to prescribe conditions under which certain public

 

employees may question a minor about firearms in the home.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1. (1) This act shall be known and may be cited as the

 

"adult oversight of firearms information act".

 

     (2) "Governmental employee" means a public health care worker,

 

public social worker, or public school personnel and includes

 

workers indirectly employed under a contract to perform those

 

services on behalf of a governmental agency.

 

     (3) Except as otherwise provided in this act, a governmental

 

employee shall not, in the course of his or her employment, ask a

 

minor for any information concerning firearms in the minor's home


or firearm ownership by a resident in the household unless a parent

 

or legal guardian of the minor is present.

 

     (4) Subsection (3) does not apply in an instance of suspected

 

child abuse or child neglect that the governmental employee is

 

required to report under section 3 of the child protection law,

 

1975 PA 238, MCL 722.623.

 

     Enacting section 1. This act takes effect 90 days after the

 

date it is enacted into law.
