SENATE BILL NO. 289

March 24, 2021, Introduced by Senators NESBITT, LASATA, HORN, THEIS, STAMAS, ZORN, BARRETT, VICTORY, DALEY, OUTMAN and VANDERWALL and referred to the Committee on Elections.

A bill to amend 1984 PA 431, entitled

"The management and budget act,"

by amending section 453 (MCL 18.1453).

the people of the state of michigan enact:

Sec. 453. (1) If appropriations are made in a budget act from restricted revenues including federal and matching revenues, the amount to be expended from the restricted revenue shall not exceed the amount appropriated in the budget act or the amount paid in, together with the balances carried forward from the previous fiscal year, whichever is the lesser.

(2) If this state or a state agency receives or is eligible to receive federal funds that must be used for election-related purposes, and the federal funds may be received or expended only after satisfying certain conditions placed by the federal government, the federal funds must not be expended except upon appropriation in a budget act. If the federal funds described in this subsection are not appropriated in a budget act within 90 days after the state or state agency receives the federal funds, the federal funds must be returned to the federal government.
