STATE OF MICHIGAN 99TH LEGISLATURE REGULAR SESSION OF 2018

ENROLLED SENATE BILL No. 822

AN ACT to clarify certain powers of the governor; and to impose certain duties on certain state officials.

The People of the State of Michigan enact:

Sec. 1. As used in this act:

(a)
“Memorandum of understanding” means an informal agreement between this state and another party that does not impose contractual duties or obligations on this state.
(b)
“Office of the great seal” means the office of the great seal located within the executive office of the Michigan department of state.

Sec. 2. If a memorandum of understanding is signed by a governor and by its terms applies after that governor leaves office, then that memorandum of understanding shall remain in effect during the term of the successive governor and subsequent successive governors until rejected by a successive governor or until it expires by its terms.

Sec. 3. (1) A copy of a memorandum of understanding signed by the governor under this act shall be filed in the office of the great seal and made available to the public. Copies of each memorandum of understanding under this act shall also be posted on the department of state internet website.

(2) The department of state shall file a copy of each memorandum of understanding under this act with each house of the legislature and the senate majority leader, the senate minority leader, the speaker of the house of representatives, and the minority leader of the house of representatives.
