1.2relating to disasters; establishing local disaster assistance program and local
1.3disaster fund; appropriating money;proposing coding for new law in Minnesota
1.4Statutes, chapter 12.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. [12.222] MINNESOTA DISASTER LOCAL ASSISTANCE
1.7PROGRAM.
1.8    Subdivision 1. Local disaster assistance program. A program is established to
1.9assist state and local governments to respond in a consistent, timely, and adequate manner
1.10when disasters occur that are ineligible for a presidential disaster declaration. The state
1.11director of the Division of Homeland Security and Emergency Management shall provide
1.12assistance and grants to local governments to respond to local disasters.
1.13    Subd. 2. Eligibility; requirements. To be eligible for assistance under this section,
1.14a political subdivision must make a local declaration of emergency in accordance with
1.15section 12.29 and apply to the state director for assistance on the forms and according
1.16to the procedures and timelines established by the commissioner of public safety. At a
1.17minimum, the application for grants must include an assessment of the damage caused by
1.18the disaster. Within the limits of the funds available under this section, the state director
1.19may award grants to assist a local government in paying for costs directly related to the
1.20disaster, including but not limited to emergency response, clean up, repair, replacement
1.21or restoration of public infrastructure, remediation to ensure public health, and other
1.22costs attributable to the disaster. A grant under this section must not duplicate or replace
1.23assistance that is available from other state or federal government agencies or insurance
2.1coverage. Each grant awarded under this section must be matched by at least ten percent
2.2from local funds.
2.3    Subd. 3. Local disaster assistance account; appropriation. (a) A local disaster
2.4assistance account is created in the special revenue fund. Money in the account is
2.5appropriated to the commissioner of public safety for grants and assistance to local units
2.6of government under this section. This account must be used for the purposes of assisting
2.7local governments to respond to and recover from disasters that do not qualify for a
2.8presidential disaster declaration. Money in the account does not cancel but is available
2.9until expended.
2.10(b) An amount necessary to maintain the account at $6,000,000 is annually
2.11appropriated on July 1 from the general fund to the local disaster assistance account.

2.12    Sec. 2. LOCAL DISASTER ASSISTANCE ACCOUNT.
2.13$6,000,000 is appropriated from the general fund in fiscal year 2012 to the local
2.14disaster assistance account in the special revenue fund under section 1. This appropriation
2.15is to assist local governments to respond to disasters that do not qualify for assistance as a
2.16presidentially declared disaster.

2.17    Sec. 3. APPROPRIATION; EMERGENCY MANAGEMENT STATE MATCH.
2.18$5,600,000 each year for fiscal years 2012 and 2013 is appropriated from the general
2.19fund to the commissioner of public safety to provide a match for Federal Emergency
2.20Management Agency (FEMA) disaster assistance payments under Minnesota Statutes,
2.21section 12.221. If the appropriation is insufficient to cover the match requirements, the
2.22amount necessary to cover the costs in that fiscal year is appropriated from the general
2.23fund. Beginning in fiscal year 2014, the base appropriation for the FEMA match is 75
2.24percent of the average annual expenditures for the state FEMA match for the preceding
2.25five years.
