1.1A bill for an act
1.2relating to state government; providing that no civil or criminal penalties may
1.3be imposed or citations issued for certain conduct when state agencies were not
1.4issuing required licenses and permits.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. NO CIVIL OR CRIMINAL PENALTY.
1.7Notwithstanding any law to the contrary, a state agency or a unit of local government
1.8may not impose a civil fine or penalty, issue a citation, or seek a criminal penalty against
1.9a person or entity for engaging in conduct after June 30, 2011, and before the day of
1.10enactment of this section, without a license or permit required by state law if:
1.11(1) the person or entity had a valid license or permit to engage in the conduct on
1.12June 30, 2011, and the license or permit expired after June 30, 2011, and before the day
1.13of enactment of this section, or the person or entity was entitled to issuance of a new
1.14license or permit upon payment of a fee without further discretionary action on the part
1.15of the state agency; and
1.16(2) the state agency responsible for issuance or renewal of the license or permit was
1.17not issuing or renewing licenses or permits after June 30, 2011; and
1.18(3) the conduct engaged in by the person or entity would have been legal if the
1.19person or entity had a valid license or permit during the period in which the state agency
1.20was not issuing licenses or permits; and
1.21(4) the person or entity obtains the required license or permit before September 1,
1.222011.
1.23EFFECTIVE DATE.This section is effective the day following final enactment
1.24and is retroactive to July 1, 2011.
