1.1A bill for an act
1.2relating to commerce; weights and measures; requiring metering of motor vehicle
1.3fuel delivered to underground storage tanks;proposing coding for new law in
1.4Minnesota Statutes, chapter 239.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. [239.82] DELIVERY AND STORAGE OF MOTOR VEHICLE FUEL;
1.7METERING.
1.8    Subdivision 1. Definitions. For the purposes of this section, the terms defined in this
1.9subdivision have the meanings given them.
1.10(a) "Metering device" means a device, approved and regulated by the division,
1.11which accurately determines the volume of motor vehicle fuel as it is dispensed from a
1.12transport truck to an underground storage tank.
1.13(b) "Motor vehicle fuel" has the meaning given in section 296A.01, subdivision 33.
1.14(c) "Transport truck" means any vehicle used to transport and deliver motor vehicle
1.15fuel to underground storage tanks for resale to the public.
1.16(d) "Underground storage tank" means any tank or vessel used to store motor vehicle
1.17fuel prior to its resale to the public, which is placed underground and has a capacity
1.18of at least 5,000 gallons.
1.19    Subd. 2. Metering devices required on transport trucks. (a) All transport trucks
1.20delivering motor vehicle fuel to underground storage tanks shall be equipped with a
1.21metering device, which must be used during delivery to generate a record indicating
1.22the exact amount, by volume, of each type or grade of motor vehicle fuel dispensed to
1.23each underground storage tank.
2.1(b) A copy of the record generated under paragraph (a) shall be provided to the
2.2operator of the underground storage tank upon completion of the delivery.
2.3EFFECTIVE DATE.This section is effective January 1, 2013, and applies to
2.4deliveries of motor vehicle fuel on or after that date.
