AN ACT

To amend chapter 136, RSMo, by adding thereto one new section relating to criminal investigators of the department of revenue criminal investigations bureau.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Chapter 136, RSMo, is amended by adding thereto one new section, to be known as section 136.045, to read as follows:

            136.045. 1. As used in this section "criminal investigators of the department of revenue" shall mean special agents, special agents-in-charge, or administrators assigned to the department of revenue criminal investigations bureau.

            2. Criminal investigators of the department of revenue who meet the requirements of chapter 590, and hold a valid peace officer license may be appointed as peace officers by the director of revenue.

            3. Criminal investigators of the department of revenue appointed as peace officers under the provisions of this section shall, before entering upon the discharge of their duties, each take and subscribe an oath to support the constitution and laws of the United States and the state of Missouri and to faithfully demean themselves in office in the form prescribed by article VII, section 11 of the Missouri Constitution. They shall receive a certificate of appointment, a copy of which shall be filed with the secretary of state, granting such police powers to enforce the laws of the state while investigating matters pertaining to state income tax, estate tax, motor vehicle drivers' license tax, motor vehicle registration fees, motor vehicle fuel tax, sales and use tax, all other taxes administered by the director of revenue, and any licensure of persons or businesses for which the director of revenue issues licenses.

            4. Notwithstanding the provisions of section 571.030, criminal investigators of the department of revenue who are certified under the requirements of this section shall have the authority to carry firearms at all times.

            5. The department of revenue shall determine the content of the required firearms safety training and provide firearms certification and recertification training for criminal investigators of the department of revenue. A minimum of sixteen hours of firearms safety training shall be required.

            6. Criminal investigators of the department of revenue appointed as peace officers under the provisions of this section shall have full power and authority as now or hereafter vested by law in peace officers when working with and at the special request of the sheriff of any county, the chief of police of any city, or the superintendent of the Missouri state highway patrol, or his or her designee.
