Summary

An Act To Require The State Department Of Education And The Mississippi Department Of Mental Health Shall Develop The Framework And Guidelines To Be Used By Public Schools For The Purpose Of Providing Mental Health Assessments And Screenings To Public School Students In Kindergarten Through Grade 12 In Order To Adequately Assess, Address And Prevent Habitually Disruptive Student Behavior, Approaches To Alternative Placement And Reintegration Into The Traditional Classroom Setting; To Require The State Board Of Education And The Mississippi Department Of Mental Health To Develop The Framework And Guidelines For Use By Public Schools In Providing Comprehensive, Coordinated Mental Health Prevention, Screenings And Assessments, Early Intervention And Treatment Services For Public School Students; To Prescribe The Minimum Requirements For The Framework And Guidelines; To Create The Children's Mental Health Partnership, Which Shall Be Responsible For Developing The Assessments And Screeners To Be Used By Certified School Employees To Detect Any Mental Health Deficiencies In Students; To Prescribe The Composition Of The Partnership; To Require The State Board Of Education To Develop And Implement A Policy Requiring All Public School Districts To Provide Mental Health Screenings And Assessments To Students In Kindergarten Through Grade 12, Who Exhibit Signs Of Mental Distress, Incapacity And Habitually Disruptive Behavior; To Prescribe The Minimum Requirements Of The Policy Content; To Require Every Public School District To Develop A Policy For Incorporating Social And Emotional Development Into The District's Educational Program; To Amend Sections 37-3-85, 37-7-301, 37-11-1, 37-11-18.1, 37-11-29, 37-11-55, 37-11-57, 37-13-92, Mississippi Code Of 1972, To Prescribe Authority To And The Processes Required By The State Board Of Education And The Local Governing School Boards To Implement Policies And Procedures To Address Habitually Disruptive Students, The Components To Be Included In Any Behavior Modification Plan Developed For The Student, Considerations For Alternative Placement And Petitioning The Youth Court For Consideration Of Placement In The Youth Challenge Program; To Amend Section 43-27-203, Mississippi Code Of 1972, In Conformity To The Preceding Provisions; And For Related Purposes.
