House Bill 1007

AN ACT TO CREATE THE BRODERICK DIXON ACT; TO AMEND SECTION 99-43-17, MISSISSIPPI CODE OF 1972, TO PROVIDE THAT THE RIGHTS OF THE VICTIM SHALL INCLUDE THE RIGHT TO APPEAL; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  This act shall be known and may be cited as the "Broderick Dixon Act."

     SECTION 2.  Section 99-43-17, Mississippi Code of 1972, is amended as follows:

     99-43-17.  The rights of the victim do not include the authority to direct the prosecution of the case.  The rights of the victim shall include the right to appeal the case without the approval of the prosecution.

     SECTION 3.  This act shall take effect and be in force from and after July 1, 2012.
