House Bill 1688

AN ACT TO AUTHORIZE THE BOARD OF SUPERVISORS OF ADAMS COUNTY, MISSISSIPPI, TO CONTRACT WITH A PRIVATE ENTITY, WHICH ENTIRELY OPERATES A CORRECTIONAL FACILITY WITHIN THE COUNTY, TO HOUSE INMATES WHO ARE SUBJECT TO THE JURISDICTION OF SUCH COUNTY; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The Board of Supervisors of Adams County, Mississippi, in its discretion, may contract with a private entity that entirely operates a correctional facility, pursuant to a contractual agreement between the private entity and Adams County, Mississippi, to provide correctional services to Adams County for the confinement of inmates subject to the jurisdiction of the county, including those awaiting transfer to any other jurisdiction or facility.  Any person confined in such a facility pursuant to the laws of the jurisdiction which he is sent shall be considered lawfully confined within this state. 

     (2)  The private entity prescribed under this section shall assume complete responsibility for the inmates subject to the jurisdiction of Adams County and shall be liable to the State of Mississippi and Adams County for any illegal or tortious actions of such inmates.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
