Senate Bill 2813

AN ACT TO REQUIRE NONEMERGENCY MEDICAL TRANSPORTATION DRIVERS TO EITHER BE CREDENTIALED BY A BROKER CONTRACTED WITH THE DIVISION OF MEDICAID OR MEET CERTAIN CRITERIA; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  As used in this act, "NEMT driver" means a nonemergency medical transportation driver transporting passengers to and/or from medical appointments where the first leg of the trip originates in Mississippi.

     (2)  NEMT drivers must either be credentialed by the broker contracted with the Division of Medicaid for fee-for-services Medicaid trips, and such credentialing must be the same for all NEMT drivers for the broker, or NEMT drivers must meet all of the following criteria:

          (a)  Possess a valid Mississippi driver's license;

          (b)  Have an automobile and general liability insurance policy with limits of at least Five Hundred Thousand Dollars ($500,000.00) per incident and One Million Dollars ($1,000,000.00) cumulative;

          (c)  Have the following items on file with the Department of Health:

              (i)  A fingerprint background check;

              (ii)  An annual national criminal background check, evidencing:

                   1.  No felonies in the past five (5) years; and

                   2.  No convictions for crimes involving drugs, physical violence or abuse;

              (iii)  An annual National Sex Offender Registry check;

              (iv)  An annual Mississippi Motor Vehicle Report, evidencing:

                   1.  Not more than two (2) moving and/or at-fault accidents;

                   2.  No DUI tickets in the past five (5) years; and

                   3.  No license suspension in the past five (5) years;

              (v)  A current Defensive Driving Certification;

              (vi)  A current CPR and first-aid training certification;

              (vii)  A current Assisting Passenger with Disabilities Certification; and

              (viii)  A current Wheelchair Transportation Training Certification if the NEMT driver performs wheelchair nonemergency medical transportation.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2020.
