Senate Bill 2878

AN ACT TO PROHIBIT POLITICAL SUBDIVISIONS FROM ADOPTING AN ORDINANCE, RESOLUTION, REGULATION, CODE OR POLICY THAT PROHIBITS THE EXPANSION, UTILIZATION, CONNECTION OR RECONNECTION OF A SERVICE BASED UPON THE TYPE OF ENERGY TO BE DELIVERED; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  No political subdivision of this state may adopt an ordinance, resolution, regulation, code or policy that prohibits, or has the effect of prohibiting, the expansion, utilization, connection or reconnection of a service based upon the type or source of energy to be delivered to an individual customer.

     (2)  For purposes of this section, the term "political subdivision" shall have the same meaning as provided in Section 11-46-1.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
