A BILL TO BE ENTITLED

AN ACT to direct state agencies to review their programs, including planning and regulatory programs that consider environmental impacts and recommend whether those programs should include consideration of the impacts of global climate change, as recommended by the legislative commission on global climate change.

The General Assembly of North Carolina enacts:

SECTION 1.  Each State agency shall review its programs, including planning and regulatory programs that consider environmental impacts and determine whether the program currently considers the impacts of global climate change.  For those programs that currently consider the impacts of global climate change, the agency shall describe how the program considers the impacts of global climate change and recommend whether the consideration of the impacts of global climate change should be modified or expanded.  For those programs that do not currently consider the impacts of global climate change, the agency shall recommend if and how the program should consider the impacts of global climate change.

SECTION 2.  No agency shall implement any recommendations identified pursuant to Section 1 of this act without authorization from the General Assembly.

SECTION 3.  No later than September 1, 2011, each State agency shall report the results of its review and any recommendations to the Department of Environment and Natural Resources.  The Department shall compile the results and recommendations and report them to the Environmental Review Commission and to any future legislative commission that directly and primarily addresses issues concerning global climate change no later than November 1, 2011.

SECTION 4.  As used in this act, "State agency" means the State of North Carolina or any board, bureau, commission, department, institution, or agency of the State.

SECTION 5.  This act is effective when it becomes law.
