A JOINT RESOLUTION AUTHORIZING THE 2009 GENERAL ASSEMBLY TO CONSIDER A BILL TO BE ENTITLED AN ACT TO ELIMINATE AS A PRETRIAL ISSUE THE CLAIM THAT RACE WAS A SIGNIFICANT FACTOR IN THE DECISION TO TRY A MURDER AS A CAPITAL CASE BUT TO PROVIDE THAT THE CLAIM MAY STILL BE RAISED IN A POSTCONVICTION PROCEDURE.

Be it resolved by the House of Representatives, the Senate concurring:

SECTION 1.  The 2009 General Assembly may consider "A BILL TO BE ENTITLED AN ACT TO ELIMINATE AS A PRETRIAL ISSUE THE CLAIM THAT RACE WAS A SIGNIFICANT FACTOR IN THE DECISION TO TRY A MURDER AS A CAPITAL CASE BUT TO PROVIDE THAT THE CLAIM MAY STILL BE RAISED IN A POSTCONVICTION PROCEDURE."

SECTION 2.  This resolution is effective upon ratification.
