A BILL TO BE ENTITLED
AN ACT to limit HIGHWAY memorializations to Public safety or military personnel killed in the line of duty and to direct the department to discontinue maintenance and upkeep of existing Memorializing signs on highways not meeting the requirements of this Act.
The General Assembly of North Carolina enacts:
SECTION 1. G.S. 136‑18(8) reads as rewritten:
"§ 136‑18. Powers of Department of Transportation.
The said Department of Transportation is vested with
the following powers:
…
(8) To give suitable names to State highways and change
the names as determined by the Board of Transportation of any highways that
shall become a part of the State system of highways.highways,
provided that the Board shall not rename a highway or a component of a highway
in the State highway system after any individual, except for law enforcement
officers, firefighters, emergency medical services personnel, or active and
reserve military personnel killed in the line of duty. For purposes of this
subdivision, "component of a highway" includes bridges, overpasses,
and any other highway structure."
SECTION 2. The Department of Transportation shall not expend funds to maintain or replace any sign previously erected by the Department in compliance with the naming of any road by the Board of Transportation for a person not described by G.S. 36‑18(8), as amended by Section 1 of this act.
SECTION 3. This act is effective when it becomes law.
