A BILL TO BE ENTITLED
AN ACT to limit the liability of Emergency Medical Services Personnel.
The General Assembly of North Carolina enacts:
SECTION 1. Article 7 of Chapter 131E of the General Statutes is amended by adding a new section to read:
"§ 131E‑161.1. Emergency medical personnel; liability limitation.
Emergency medical personnel, as defined in G.S. 131E‑155, shall not be liable for damages for personal injury or death alleged to have been sustained as a result of acts or omissions in the performance of their duties, unless it is established that the personal injury or death was caused by gross negligence, wanton conduct, or intentional wrongdoing on the part of the emergency management personnel."
SECTION 2. This act becomes effective July 1, 2013, and applies to causes of action arising on or after that date.
