Short Title:        Increase Safety/Professional Housemoving.

A BILL TO BE ENTITLED

AN ACT to improve safety on the roads and highways of this state by increasing the accountability of certain parties involved in professional housemoving.

The General Assembly of North Carolina enacts:

SECTION 1.  G.S. 20‑356(2) reads as rewritten:

"(2)      House. – A dwelling, building, or other structure in excess of 15 feet in width. Mobile homes, manufactured homes, or modular homes, or portions thereof, are not within this definition when being transported from the manufacturer or from a licensed retail dealer location to the first set‑up site."

SECTION 2.  G.S. 20‑362 reads as rewritten:

"§ 20‑362.  Liability of housemovers.Liability.

(a)        TheExcept as provided in subsections (b) and (c) of this section, the permittee assumes all responsibility for injury to persons or damage to property of any kind and agrees to hold the Department harmless for any claims arising out of his conduct or actions.resulting from the housemoving.

(b)        The manufacturer and permittee shall be jointly and severally liable for injury to persons or damage to property resulting from the transport of mobile homes, manufactured homes, modular homes, or portions thereof, from the manufacturer to the first retail dealer location. If the mobile home, manufactured home, modular home, or portion thereof, is being transported from the manufacturer directly to the first set‑up site, then the manufacturer and permittee shall be jointly and severally liable for injury to persons or damage to property resulting from the transport of the mobile home, manufactured home, modular home, or portion thereof, from the manufacturer directly to the first set‑up site.

(c)        The licensed retail dealer and permittee shall be jointly and severally liable for injury to persons or damage to property resulting from the transport of mobile homes, manufactured homes, modular homes, or portions thereof, from the retail dealer location to the first set‑up site.

(d)        The Department shall be held harmless for any claims arising out of the conduct or actions of a permittee."

SECTION 3.  This act becomes effective October 1, 2015, and applies to injuries to persons or damage to property resulting from housemovings on or after that date.
