A BILL TO BE ENTITLED

AN ACT to limit the number of studies conducted by metropolitan planning organizations and rural transportation planning organizations.

The General Assembly of North Carolina enacts:

SECTION 1.  G.S. 136‑202 is amended by adding a new subsection to read:

"(a1)     Subject to the provisions of 23 U.S.C. § 134, and notwithstanding any State law to the contrary, each Metropolitan Planning Organization shall only conduct studies for projects that the Metropolitan Planning Organization has funding available to begin work on or complete."

SECTION 2.  G.S. 136‑212 reads as rewritten:

"§ 136‑212.  Duties of Rural Transportation Planning Organizations.

(a)        The duties of a Rural Transportation Planning Organization shall include, but not be limited to:

(1)        Developing, in cooperation with the Department, long‑range local and regional multimodal transportation plans.

(2)        Providing a forum for public participation in the transportation planning process.

(3)        Developing and prioritizing suggestions for transportation projects the organization believes should be included in the State's Transportation Improvement Program.

(4)        Providing transportation‑related information to local governments and other interested organizations and persons.

(b)        Notwithstanding any State law to the contrary, each Rural Transportation Planning Organization shall only conduct studies for projects that the Metropolitan Planning Organization has funding available to begin work on or complete."

SECTION 3.  This act is effective when it becomes law and applies to studies conducted on or after that date.
