A BILL TO BE ENTITLED
AN ACT to address the costs of reproducing public records by allowing the recovery of personnel costs associated with providing copies.
The General Assembly of North Carolina enacts:
SECTION 1. G.S. 132‑1(b) reads as rewritten:
"(b) The public records and public information
compiled by the agencies of North Carolina government or its subdivisions are
the property of the people. Therefore, it is the policy of this State that the
people may obtain copies of their public records and public information free or
at minimal cost unless otherwise specifically provided by law. As used herein, "minimal
cost" shall mean the actual cost of reproducing the public record or
public information.information, including the personnel costs
associated with the amount of time spent reproducing the record or information,
which shall be computed based upon the minimum wage in this State in effect
under Article 2A of Chapter 95 of the General Statutes."
SECTION 2. This act is effective when it becomes law.
