A BILL TO BE ENTITLED

AN ACT to prohibit employment discrimination on the basis of credit history or credit rating.

The General Assembly of North Carolina enacts:

SECTION 1.  Article 3 of Chapter 95 of the General Statutes is amended by adding a new section to read:

"§ 95‑28.1B.  Discrimination against persons based on credit history or credit rating prohibited.

(a)        Except as allowed in subsection (b) of this section, no person, firm, corporation, unincorporated association, State agency, unit of local government, or any public or private entity shall deny or refuse employment to any person on account of the person's credit history or credit rating.

(b)        An employer may request a prospective employee to submit to a credit history background check as part of the application process if creditworthiness or credit standing is directly related to the ability to perform essential functions of the employment sought."

SECTION 2.  This act becomes effective October 1, 2013.
