Short Title:        Modify Hearing & Mailings for Rule Making.

A BILL TO BE ENTITLED

AN ACT to require greater notification of and ability to attend hearings for rule making.

The General Assembly of North Carolina enacts:

SECTION 1.  G.S. 150B‑21.2(a) reads as rewritten:

"(a)       Steps. – Before an agency adopts a permanent rule, it must take the following actions:

(1)        Publish a notice of text in the North Carolina Register.

(1a)      For each county that will be impacted by the proposed rule, notify the governing unit of and publish in at least one newspaper having general circulation in each county specific instructions as to how to access, by Internet, the notice of text published in the North Carolina Register.

(2)        When required by G.S. 150B‑21.4, prepare or obtain a fiscal note for the proposed rule.

(3)        Repealed by Session Laws 2003‑229, s. 4, effective July 1, 2003.

(4)        When required by subsection (e) of this section, hold a public hearing on the proposed rule after publication of the proposed text of the rule.rule within 60 miles of each county that will be impacted by the proposed rule and from which a resident timely submitted a written request for a public hearing.

(5)        Accept oral or written comments on the proposed rule as required by subsection (f) of this section."

SECTION 2.  This act is effective when it becomes law and applies to rules adopted on or after that date.
