ANALYSIS

 

This bill modifies the Gunstock Area Commission distribution of revenues, requires that public meetings of the commission be recorded, and establishes a schedule for forensic audits of the commission.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Four

 

AN ACT relative to the Gunstock Area Commission and ski resort.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Gunstock Area Commission; Appropriations and Revenues.  Amend 1957, 399:14 as amended by 1973, 263:4(c) and 2020, 18:2 to read as follows:

(c)  The commission is hereby authorized and empowered to use the revenues from the area to carry out any and all of the purposes herein stated, and is hereby especially authorized and empowered to retain any profits from the operation of the area and invest the same for the purpose of future maintenance, operation, improvements of the area, and for working capital, except that upon a vote of the county convention [1.75] 3 percent of yearly gross [operating income] revenue, excluding donations and grants, shall be turned over to the Belknap county treasurer within 45 days of the receipt and approval of the annual audit.

2  Gunstock Area Commission; Meetings to be Recorded.  Subject to the provisions of 91-A:3, all public meetings of the Gunstock Area Commission shall be recorded.  Subject to the provisions of RSA 91-A:3, not more than 5 business days after the meeting, except as provided in RSA 91-A:6, recordings shall be posted on the commission's website.

3  Gunstock Area Commission; Forensic Audit Required.  The Gunstock Area Commission shall every 5 years contract a firm other than the firm which conducts the annual audit to, following the first forensic audit, conduct a forensic audit of a random year in the preceding 5 year period.  The commission shall contract with such firm within 90 days of the effective date of this act and the first forensic audit shall be for the fiscal year ending April 30, 2021.

4  Effective Date.  This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill modifies the Gunstock Area Commission county convention from 1.75% to 3.00% and changes the calculation base from operating income to revenue, excluding donations and grants. The New Hampshire Association of Counties states based on external information the doubling of the percentage would increase county revenue by an estimated $300,000 per a fiscal year.  

 

It is assumed the fiscal impact of this bill would not occur until FY 2025.
