     Exempts employees and school board members of federal impact aid districts from certain out-of-state travel restrictions.

An Act concerning travel restrictions for employees and school board members of certain school districts and supplementing chapter 11 of Title 18A of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    An employee or school board member of a school district that receives federal impact aid pursuant to sections 8002 and 8003 of the Elementary and Secondary Education Act of 1965 (20 U.S.C. ss.7702 and 7703), shall not be subject to the restrictions on out-of-state travel regarding allowable modes of transportation and reimbursement rates for transportation, meals, and lodging which are set forth in section 15 of P.L.2007, c.53 (C.18A:11-12) and rules promulgated thereto; provided that the out-of-state travel is directly related to securing the federal impact aid.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill would exempt employees and school board members of school districts that receive federal impact aid from certain restrictions on out-of-state travel, provided that the travel is directly related to securing the federal impact aid.  The restrictions on out-of-state travel from which the employees and board members would be exempt are the limits on allowable modes of transportation and the amount of permissible reimbursement for transportation, meals and lodging.

     Pursuant to P.L.2007, c.53, effective March 15, 2007, new Statewide travel restrictions were imposed on school board members and district employees.  Some of these restrictions have imposed an undue hardship on school districts that receive federal impact aid.  Board members and employees from these districts actively pursue federal impact aid for the support of their districts.  This frequently requires out-of-state travel for these individuals.  An exemption from certain of the out-of-state travel restrictions would be beneficial in allowing these districts to successfully maintain their active role in securing these federal funds.
