SYNOPSIS

     Requires State contracts for internet software to include indefinite support from software manufacturer.

An Act concerning State contracts for internet software and supplementing chapter 34 of Title 52 of the Revised Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    Every contract between a State agency and a manufacturer or vendor of internet software for the licensing and use of internet software shall include an agreement by the manufacturer or vendor to continue to provide support and updates for such internet software to the State agency for as long as the State agency utilizes the software.  Every State contract for such software shall further specify that if support services for internet software are discontinued, the manufacturer or vendor shall be responsible for upgrading the affected computer system to software for which support services are still being offered.

     As used in this section, "State agency" means any of the principal departments in the Executive Branch of the State Government, and any division, board, bureau, office, commission or other instrumentality within or created by such department, and any independent State authority, commission, instrumentality or agency.

     The provisions of this section shall not apply to any contract when the public exigency requires the immediate delivery of such internet software.

     The provisions of this section shall not apply to any contract that is paid for in whole or in part with federal funds if application thereto would affect eligibility to receive those funds.

 

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill would require every State contract for internet software to include ongoing support from the manufacturer or vendor of such software.  If support services for internet software are discontinued, the manufacturer or vendor would be responsible for upgrading the affected computer system to software for which support services are still being offered.

     Under this bill, a State contract would mean a contract of any of the principal departments in the Executive Branch of the State Government, and any division, board, bureau, office, commission or other instrumentality within or created by such department, and any independent State authority, commission, instrumentality or agency.
