     Allows board of county commissioners to remove commissioner if that member misses three consecutive board meetings without excused absence.

An Act authorizing removal of county commissioners after certain absences and supplementing chapter 20 of Title 40 of the Revised Statutes and P.L.1972, c.154 (C.40:41A-1 et seq.). 

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    In the event that a member of a board of county commissioners fails to attend three consecutive meetings of the board without good cause, as determined by the board, the board may remove that member from the board by an affirmative vote of a majority of the board members present.  Any vacancy created following the removal of a member pursuant to this section shall be filled in accordance with the provisions of chapter 20 of Title 40 of the Revised Statutes for the remainder of the member's term.  

 

     2.    In the event that a member of a board of county commissioners, operating under the provisions of the "Optional County Charter Law," P.L.1972, c.154 (C.40:41A-1 et seq.), fails to attend three consecutive meetings of the board without good cause, as determined by the board, the board may remove that member from the board by an affirmative vote of a majority of the board members present.  Any vacancy created following the removal of a member pursuant to this section shall be filled in accordance with the provisions of section 5 of P.L.1990, c.33 (C.40:41A-145.1) for the remainder of the member's term. 

 

     3.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill provides that, in the event that a member of a board of county commissioners fails to attend three consecutive meetings of the board without good cause, as determined by the board, that member may be removed from the board of county commissioners by an affirmative vote of a majority of the board members present.  The bill provides that any vacancy created by such a removal is required to be filled in accordance with the provisions of chapter 20 of Title 40 of the Revised Statutes for the remainder of the member's term, or as provided in the bill.

     This bill mirrors language in N.J.S.18A:12-3 allowing a board of education to remove a member of the board if that member fails to attend three consecutive meetings of the board without good cause.
