An Act concerning deer carcass removal, supplementing Title 27 of the Revised Statutes, and making an appropriation.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    The Commissioner of Transportation shall provide for the removal and disposal of deer carcasses from county and municipal roads, and may enter into agreements that provide for such removal and disposal.

 

     2.    There is appropriated $730,000 from the General Fund to the Department of Transportation for the purpose of implementation of this act.

 

     3.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill requires the Commissioner of Transportation to provide for the removal and disposal of deer carcasses from county and municipal roads, and allows the Commissioner to enter into agreements to provide for such removal and disposal.

     Traditionally, the removal of carcasses from all roads throughout New Jersey has been the responsibility of the Department of Transportation.  However, there is nothing in the law explicitly requiring the State to carry out this task.  In light of the Department's decision to cease removing deer carcasses from county and local roads, it has become necessary to explicitly direct the State to continue providing this service to ensure that the cost of deer carcass removal is not passed on to county and municipal governments, which could result in a subsequent increase in property taxes.

     The bill makes an appropriation of $730,000 to the Department of Transportation to provide for the removal of deer carcasses from county and municipal roads.
