SYNOPSIS

     Establishes a three-year moratorium on the establishment of new charter schools.

An Act concerning the establishment of charter schools and supplementing P.L.1995, c.426 (C.18A:36A-1 et seq.).

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    For a period of three  years following the effective date of P.L.   , c.     (C.     ) (pending before the Legislature as this bill), the Commissioner of Education shall not approve any application for the establishment of a charter school submitted pursuant to section 4 of P.L.1995, c.426 (C.18A:36A-4).  At the end of the three-year period, prior to the approval of any application for the establishment of a new charter school, the commissioner shall consider applications or proposed charter amendments submitted for the expansion of the approved enrollment or grade levels of existing charter schools.

 

     2.    This act shall take effect on October 1 next following enactment.

 

 

STATEMENT

 

     This bill provides that for a three-year period following the bill's effective date, the Commissioner of Education will not approve any application for the establishment of a charter school.  At the end of the three-year period, prior to the approval of any application for the establishment of a new charter school, the commissioner must consider applications or proposed charter amendments submitted for the expansion of the approved enrollment or grade levels of existing charter schools.

     The bill becomes effective October 1 following enactment as the commissioner is required to issue his annual approval of new charter school applications by September 30.
