SYNOPSIS

     Transfers $5,000,000 of unexpended balance from Purchase of Service for Inmates Incarcerated in County Penal Facilities account in Fiscal Year 2011 Annual Appropriations Act and appropriates that amount for Women's Health and Family Planning Services.

An Act transferring $5,000,000 of certain unexpended balance for appropriation to support Women's Health and Family Planning Services, amending the Fiscal Year 2011 annual appropriations act, P.L.2010, c.35.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    The following language provision in section 1 of P.L.2010, c.35, the annual appropriations act for State fiscal year 2011, is amended to read as follows:

 

26 DEPARTMENT OF CORRECTIONS

10 Public Safety and Criminal Justice

16 Detention and Rehabilitation

7025 System-Wide Program Support

GRANTS-IN-AID

 

The unexpended balance at the end of the preceding fiscal year in the Purchase of Service for Inmates Incarcerated in County Penal Facilities account is appropriated for the same purpose; provided however, that of such unexpended balance the sum of $5,000,000 is transferred to the Department of Health and Senior Services and is appropriated for Women's Health and Family Planning Services.  No amount from the appropriation for Women's Health and Family Planning Services shall be used to fund abortion procedures.

     2.    This act shall take effect immediately.

 

 

STATEMENT

 

     This bill expands the availability of family planning services in State fiscal year 2010-2011 (FY2011) by making appropriations of $5,000,000, from funds already appropriated but not currently committed for expenditure for specific purposes, otherwise available and appropriated for Women's Health and Family Planning Services in FY2011.  The bill strictly prohibits the use of the $5,000,000 for abortion procedures. 

     To make this bill cost-neutral from a budgeting perspective, the bill transfers and appropriates for Women's Health and Family Planning Services $5,000,000 from the unexpended balance of the Purchase of Service for Inmates Incarcerated in County Penal Facilities account. 

     In fiscal year 2010, the State appropriated $7,590,000 for grants to organizations providing family planning services.  The appropriations act for State FY2011 as proposed by the Governor, and enacted over objections, irresponsibly eliminates that funding, thereby severely impairing New Jerseyans' access to vital health care services.  This bill ensures that the State makes adequate resources available to individuals looking for services related to family planning, such as information and counseling on reproductive choices and birth control methods; comprehensive physicals and health screenings; pelvic and breast exams; pregnancy testing; the diagnosis and treatment of sexually transmitted diseases; AIDS testing and counseling; prenatal substance abuse programs; colposcopy, cryotherapy, and loop electrosurgical excision procedures; and adolescent risk reduction counseling.
